【摘要】：上海自貿(mào)試驗(yàn)區(qū)三年實(shí)踐,人們能夠明顯感覺(jué)到其發(fā)展的法治路徑日益清晰,然而,我們也必須清醒認(rèn)識(shí)到,隨著自貿(mào)試驗(yàn)區(qū)改革開(kāi)放的進(jìn)一步深入,法治的瓶頸問(wèn)題亦日益凸顯。從行政推動(dòng)轉(zhuǎn)向立法推動(dòng)、增設(shè)自貿(mào)試驗(yàn)區(qū)法制委員會(huì)、依法提高開(kāi)放程度及其可預(yù)期性、嘗試抽象性行政行為的司法審查、加大對(duì)國(guó)際條約和慣例的司法適用、增加對(duì)失信企業(yè)懲處的法律供給、完善金融風(fēng)險(xiǎn)的防范機(jī)制等,則是自貿(mào)試驗(yàn)區(qū)法治深化需要解決的問(wèn)題,需要更大程度地發(fā)揮法治引領(lǐng)改革的作用。
[Abstract]:After three years of practice in the Shanghai Free Trade Test Zone, people can clearly feel that the legal path to its development is becoming increasingly clear. However, we must also be soberly aware that with the further deepening of the reform and opening up in the free trade experimental area, The bottleneck of the rule of law is also increasingly prominent. From the administrative push to the legislative promotion, the establishment of the legal system committee of the free trade experimental area, the enhancement of the degree of openness and its predictability in accordance with law, the attempt at judicial review of abstract administrative acts, and the increase in the judicial application of international treaties and practices, Increasing the legal supply of punishment to the dishonest enterprises and perfecting the prevention mechanism of financial risks are the problems that need to be solved in the deepening of the rule of law in the free trade experimental area, and the role of the rule of law in leading the reform of the rule of law should be brought into play to a greater extent.
