【摘要】：法治理念是指法治的理想和信念,是人們對(duì)法治的價(jià)值追求和實(shí)現(xiàn)途徑抱有的崇高理想和堅(jiān)定信念。她回答的是什么是法治、為什么要實(shí)現(xiàn)法治和怎樣實(shí)現(xiàn)法治的問(wèn)題。社會(huì)主義法治理念是在社會(huì)主義制度條件下形成的,對(duì)維護(hù)、促進(jìn)社會(huì)主義法治具有重大作用的關(guān)于法治的理想和信念。其包含的基本內(nèi)容為：依法治國(guó)、執(zhí)法為民、公平正義、服務(wù)大局和黨的領(lǐng)導(dǎo)。資本主義法治理念是在資本主義制度條件下形成的,對(duì)維護(hù)、促進(jìn)資本主義法治具有重大作用的關(guān)于法治的理想和信念。其包含的基本內(nèi)容為：依法治國(guó)、保障人權(quán)、公平正義、分權(quán)制衡和司法獨(dú)立。社會(huì)主義法治理念與資本主義法治理念是法治發(fā)展進(jìn)程中形成的兩種類(lèi)型的法治理念,她們之間既有聯(lián)系又有區(qū)別,社會(huì)主義法治理念是對(duì)資本主義法治理念的批判繼承和發(fā)展超越。在價(jià)值追求上,社會(huì)主義法治理念與資本主義法治理念具有形式上的共同點(diǎn),但在具體內(nèi)容上則有質(zhì)的區(qū)別；在實(shí)現(xiàn)途徑上,兩者卻是完全不一樣的,社會(huì)主義法治理念強(qiáng)調(diào)的是服務(wù)大局和黨的領(lǐng)導(dǎo),而資本主義法治理念則提倡司法獨(dú)立和分權(quán)制衡。以社會(huì)主義法治理念對(duì)照我國(guó)今天的法治建設(shè),我們還存在著諸多不足之處,我們應(yīng)該在社會(huì)主義法治理念的指引下不斷完善社會(huì)主義法治建設(shè)。
[Abstract]:The concept of the rule of law refers to the ideal and belief of the rule of law, the lofty ideal and firm belief that people hold in the pursuit of the value of the rule of law and the way to realize it. The ideals and beliefs about the rule of law, which play an important role in the socialist rule of law, include the following basic contents: ruling the country by law, enforcing the law for the people, being fair and just, serving the overall situation and the leadership of the Party. The ideals and beliefs of governing the country include: governing the country according to law, guaranteeing human rights, fairness and justice, checking and balancing power and judicial independence. In the value pursuit, the socialist concept of rule of law and the capitalist concept of rule of law have formal similarities, but there are qualitative differences in the specific content; in the way of realization, the two are completely different, the socialist concept of rule of law emphasizes the overall situation and the party. Compared with our country's legal construction today, we still have many shortcomings. We should constantly improve the socialist legal construction under the guidance of the socialist legal concept.
