【摘要】：基于習(xí)慣法的傳統(tǒng)治理路徑忽視了習(xí)慣本身的復(fù)雜性,它形成了治理向度的外部性、治理價(jià)值取向上的單一性、治理方法論上經(jīng)驗(yàn)主義的單維度研究結(jié)論。借助布迪厄的"慣習(xí)"系統(tǒng)理論,"慣習(xí)"自身的復(fù)雜性得以揭示,它具有生成性和建構(gòu)性,能夠在法治結(jié)構(gòu)與個(gè)體內(nèi)心圖式之間形成良好互動(dòng)的關(guān)系。而"慣習(xí)"系統(tǒng)與法律系統(tǒng)的動(dòng)態(tài)雙向運(yùn)行促成了回應(yīng)型法的生成,并推動(dòng)了治理法治化的階段性發(fā)展,最終形成一種治理法治化的身體化表征。
[Abstract]:The traditional governance path based on customary law neglects the complexity of habit itself, which forms the externality of governance orientation, the singularity of governance value orientation, and the one-dimensional conclusion of empiricism in governance methodology. With the help of Bourdieu's "habit" system theory, the complexity of "habit" itself can be revealed that it is generative and constructive, and can form a good interaction between the structure of rule of law and the internal schema of individual. The dynamic bi-directional operation of the "habit" system and the legal system promotes the formation of the responsive method, and promotes the stage development of the governance by law, and finally forms a kind of body representation of the rule of law.
