【摘要】：網(wǎng)絡環(huán)境下知識產權的傳統(tǒng)特征有所變化,并呈現(xiàn)出權利對象多樣化、作品的技術性更強等新的特征。當前,我國網(wǎng)絡知識產權保護面臨法律規(guī)定不完善、主體身份確定難、證據(jù)收集與保存難、侵權責任認定難等困境。為貫徹國家知識產權戰(zhàn)略,解決網(wǎng)絡知識產權糾紛,我國應從現(xiàn)實需求出發(fā),借鑒國外相關經(jīng)驗,構建完備的網(wǎng)絡知識產權保護法律體系,強化知識產權行政執(zhí)法和司法保護,增強公民的網(wǎng)絡知識產權保護意識。
[Abstract]:Under the network environment, the traditional characteristics of intellectual property have been changed, and the new features such as the diversity of the right objects and the more technical features of the works are presented. At present, the protection of network intellectual property rights in our country is faced with some difficulties, such as imperfection of laws and regulations, determination of subject identity, collection and preservation of evidence, identification of tort liability, and so on. In order to carry out the national intellectual property strategy and solve the network intellectual property disputes, our country should start from the actual demand, draw lessons from the relevant experience of foreign countries, construct a complete network intellectual property protection legal system, strengthen the intellectual property administrative law enforcement and judicial protection. Enhance citizens' awareness of the protection of intellectual property rights on the Internet.
