【摘要】：新中國(guó)成立伊始,我國(guó)從基本國(guó)情出發(fā),對(duì)出入境活動(dòng)及人員管理制定了相應(yīng)的法律法規(guī),促進(jìn)了我國(guó)與世界各國(guó)政治、經(jīng)濟(jì)、文化等領(lǐng)域的交往。特別是《中華人民共和國(guó)護(hù)照法》的頒布實(shí)施,推動(dòng)我國(guó)的出入境管理步入法治化軌道。但出入境管理法律體系本身存在許多缺陷,如立法技術(shù)方面、管理體制方面等均不同程度地存在問(wèn)題,特別是1985年制定、1986年開(kāi)始實(shí)施的《中華人民共和國(guó)公民出境入境管理法》和《中華人民共和國(guó)外國(guó)人入境出境管理法》——我國(guó)出入境管理工作中的“基本兩法”在全球化背景下逐漸暴露出與我國(guó)社會(huì)發(fā)展、與國(guó)際形勢(shì)要求等不適應(yīng)之處,在很大程度上限制了出入境管理在國(guó)家對(duì)外開(kāi)放和國(guó)際交流中應(yīng)有優(yōu)勢(shì)的發(fā)揮。目前國(guó)務(wù)院法制辦公室就《中華人民共和國(guó)出境入境管理法》(送審稿)已廣泛征求了意見(jiàn),并進(jìn)行了審查修改,即將提交全國(guó)人大常委會(huì)審議。本文結(jié)合21世紀(jì)以來(lái)境外移民法的發(fā)展情況,從分析我國(guó)出入境管理法治化現(xiàn)狀及存在的問(wèn)題入手,探討了我國(guó)出入境管理法治化的現(xiàn)狀與未來(lái),對(duì)相關(guān)立法活動(dòng)、管理體制改革方面,尤其是出入境管理信息化、科學(xué)化、智能化方面提出了建議。我國(guó)的出入境管理法治化要具備科學(xué)完善的出入境管理法律體系,和諧、科學(xué)、健全、合理的出入境管理體制,運(yùn)用現(xiàn)代化技術(shù)和科技手段依法對(duì)出入境活動(dòng)和人員進(jìn)行有效治理。
[Abstract]:Since the founding of New China, China has formulated relevant laws and regulations on entry-exit activities and personnel management in accordance with the basic national conditions, which has promoted the political, economic and cultural exchanges between China and other countries in the world. Especially, the promulgation and implementation of the Passport Law of the People's Republic of China has pushed the entry-exit management of China into the orbit of legalization. There are many defects in the legal system of entry control, such as legislative technology and administrative system. Especially, the Law of the People's Republic of China on the Administration of Citizens'Exit and Entry and the Law of the People's Republic of China on the Administration of Aliens' Entry and Exit, which was enacted in 1985 and implemented in 1986, are the problems in China's entry and exit control. Under the background of globalization, the "basic two laws" in the work of science and technology gradually expose the inadaptability to the social development of our country and the requirements of the international situation. To a great extent, it restricts the exertion of the advantages that exit and entry administration should have in opening up to the outside world and in international exchanges. The Law on Entry and Exit Management has been widely consulted, reviewed and revised, and will be submitted to the Standing Committee of the National People's Congress for consideration. Suggestions are put forward on the related legislative activities and the reform of the management system, especially on the informationization, scientization and intellectualization of the entry-exit management. The law effectively manages entry and exit activities and personnel.
