【摘要】：土地是一種日益稀少和不可再生的資源,對人類的經(jīng)濟社會活動起著重要的調(diào)控作用。中國雖然實行“實行世界上最嚴格的土地管理制度”,但近年來,小產(chǎn)權(quán)房建設、部省重點項目未批先建等等,一批規(guī)模大、范圍廣、影響差的非法占用土地現(xiàn)象成為社會關(guān)注的熱點難點問題。土地管理法律法規(guī)對違法行為規(guī)定了相應的行政、民事及刑事責任;土地行政主管部門通過土地督察制度的建立、例行督察制度的探索等,嚴厲打擊非法占地行為,但實際效果并不明顯,非法占地案件數(shù)量、非法占用土地面積均逐年上升。配套法規(guī)的缺位、管理制度的限制、法治與實際的脫節(jié),無疑是最迫切需要解決的問題,而找準問題癥結(jié),擺脫桎梏束縛,才能實現(xiàn)保障發(fā)展和保護土地的“雙保”目標。 本文通過數(shù)量研究、比較研究、實證分析研究等方法,首先列舉近年來非法占用土地的現(xiàn)實數(shù)據(jù)和存在形式,然后分別從非法占用土地的法治困境及土地執(zhí)法監(jiān)察狀況著手,詳細解讀我國非法占用土地的法治困局,圍繞完善土地管理法律基本要義和增加非法占地法律責任的內(nèi)容兩個方面闡述,并提出遵照保障性住房制度規(guī)制小產(chǎn)權(quán)房的建設性思路,以期達成破解非法占地法律困局的路徑設想。
[Abstract]:Land is an increasingly scarce and non-renewable resource, which plays an important role in regulating human economic and social activities. Although China has implemented the "implementation of the most stringent land management system in the world," in recent years, the construction of small property houses, the construction of key provincial projects without approval, and so on, have been on a large scale and have a wide scope. The phenomenon of illegal occupation of land with poor influence has become a hot and difficult issue of social concern. The land administration laws and regulations stipulate corresponding administrative, civil and criminal liabilities for illegal acts; the land administration departments severely crack down on illegal occupation of land through the establishment of the land supervision system and the exploration of the routine supervision system. But the actual effect is not obvious. The number of illegal occupation cases and the illegal occupied land area are increasing year by year. The absence of supporting laws and regulations, the restriction of management system and the disconnection between the rule of law and reality are undoubtedly the most urgent problems that need to be solved. Only by finding the crux of the problem and getting rid of the shackles can we realize the goal of "double protection" to ensure the development and protect the land. By means of quantitative research, comparative study, empirical analysis and so on, this paper first enumerates the actual data and existing forms of illegal occupation of land in recent years, and then starts from the dilemma of illegal occupation of land and the situation of land law enforcement supervision, respectively. It explains in detail the difficult situation of the rule of law of illegal occupation of land in our country, and expounds the basic meaning of perfecting the law of land management and the content of increasing the legal liability of illegal occupation of land. It also puts forward the constructive idea of regulating the small property right house according to the indemnificatory housing system, in order to reach the idea of solving the illegal occupation law dilemma.
