【摘要】：在我國(guó)全面深化改革進(jìn)入攻堅(jiān)期、步入深水區(qū)的關(guān)鍵時(shí)期,經(jīng)濟(jì)體制改革成為改革之重點(diǎn)。"使市場(chǎng)在資源配置中發(fā)揮決定性作用"和"更好發(fā)揮政府的作用"成為經(jīng)濟(jì)體制改革成敗的關(guān)鍵,而其突破口在于依靠法治思維和法治方式改革和創(chuàng)新政府管制。負(fù)面清單模式蘊(yùn)涵著法治經(jīng)濟(jì)思維,有助于推動(dòng)政府放松管制和創(chuàng)新管制。當(dāng)前我國(guó)政府管制過程中尚存在角色行為失當(dāng)、權(quán)力約束失衡、責(zé)任追究失位等弊端,實(shí)行負(fù)面清單模式可進(jìn)一步推動(dòng)以厘清政府與市場(chǎng)關(guān)系、改革行政審批、破除行政壟斷等為重心的政府管制法治化改革與創(chuàng)新。與此同時(shí),也應(yīng)高度警惕政府管制改革和創(chuàng)新過程中,尤其是負(fù)面清單模式的推進(jìn)給國(guó)內(nèi)市場(chǎng)可能帶來的管制脫序風(fēng)險(xiǎn)與反競(jìng)爭(zhēng)威脅。
[Abstract]:In the critical period of deepening the reform in China and stepping into the deep water area, the reform of the economic system has become the focus of the reform. " Making the market play a decisive role in the allocation of resources "and" better play the role of the government "becomes the key to the success or failure of the economic system reform, and its breakthrough lies in relying on the rule of law thinking and the rule of law reform and innovation of government control. The model of negative list contains economic thinking of rule by law and helps to promote government deregulation and innovation. At present, there are still some drawbacks in the process of government regulation in our country, such as malpractice of role, imbalance of power and restriction, responsibility investigation, etc. The negative list model can be further promoted to clarify the relationship between the government and the market, and to reform the administrative examination and approval. The reform and innovation of government regulation by law, such as breaking administrative monopoly and so on. At the same time, we should also be highly alert to the possible risks of regulatory disordering and anti-competitive threats brought to the domestic market by the promotion of the negative list model in the process of government regulation reform and innovation.
