協(xié)商民主視閾中的大學(xué)章程合法性建構(gòu)——基于大學(xué)章程制定與實(shí)施的理性反思

【摘要】:大學(xué)章程的合法性不僅來(lái)源于法律的授予,還由遵守它們的人們所賦予,應(yīng)是相關(guān)自由平等的利益主體基于權(quán)利和理性經(jīng)過(guò)普遍民主協(xié)商的結(jié)果。章程制定主體恪遵"依法制章"的原則使大學(xué)章程獲得了法律層面上的合法性,卻相對(duì)忽視了協(xié)商民主作為大學(xué)章程合法性另一重要來(lái)源的事實(shí)和依據(jù)。章程協(xié)商機(jī)構(gòu)地位不受重視、政府與師生基本被排除在章程制定主體之外以及公共理性審視不足成為建構(gòu)大學(xué)章程合法性的羈絆。唯有深度融入?yún)f(xié)商民主理念與實(shí)踐,凸顯大學(xué)章程的協(xié)商性,大學(xué)章程才能獲致合法性和正當(dāng)性,才能擔(dān)綱起為大學(xué)治理和善治提供合法性依據(jù)和制度支撐的使命。
[Abstract]:The legitimacy of university charter not only comes from the conferment of law, but also by the people who abide by it. It should be the result of the universal democratic negotiation based on the rights and rationality of the relevant free and equal interest subjects. The principle of obeying the principle of "making regulations according to law" makes the constitution of the university obtain the legitimacy on the legal level, but ignores the fact and the basis that the deliberative democracy is another important source of the legitimacy of the charter of the university. The status of the constitution consultation institution is ignored, the government and teachers and students are basically excluded from the constitution making subject and the lack of public rational examination becomes the fetters to construct the legitimacy of the university constitution. Only by deeply integrating the democratic idea and practice of negotiation, highlighting the consultative nature of the university charter, can the university charter obtain legitimacy and legitimacy, and can it assume the mission of providing legitimacy and institutional support for university governance and good governance.
