【摘要】：社會公共性衰微是當前農村基層治理的難點問題。立足于農村現(xiàn)代化轉型的社會語境,現(xiàn)代法治得以進入農村公共性難題化解的實踐場域,在"送法下鄉(xiāng)"與"迎法下鄉(xiāng)"的互動過程中確定其入場路徑,于正式規(guī)則與非正式規(guī)則的交織融合中獲得具體的入場形態(tài)。法治之于農村基層治理公共性難題化解的作用發(fā)揮,其基礎在于法治本身的豐富功能,其操作則應著眼于農村社會主體公共性的制度構建、行為公共性的規(guī)范依據提供以及農村公共性實踐的法律保障等方面。基于法治自身發(fā)展程度、法律的內在局限以及法律規(guī)范與農村其他社會規(guī)范相容程度等限制,法治之于農村基層治理公共性難題化解的作用發(fā)揮也存在不可忽視的邊界。
[Abstract]:The decline of social publicity is a difficult problem in rural grassroots governance. Based on the social context of the rural modernization transformation, the modern rule of law can enter the practical field of resolving the rural public problems, and determine its entrance path in the interactive process of "sending the law to the countryside" and "welcoming the law to the countryside". In the formal rules and informal rules intertwined to obtain the specific admission pattern. The function of the rule of law in solving the problems of rural grass-roots governance is based on the rich function of the rule of law itself, and its operation should focus on the system construction of the public nature of the main body of the rural society. The normative basis of behavior publicity and the legal protection of rural public practice and so on. Based on the degree of development of the rule of law itself, the inherent limitations of the law and the compatibility of the legal norms with other social norms in rural areas, there is also a boundary that can not be ignored in the role of the rule of law in resolving the public problems of rural grass-roots governance.
