【摘要】：政府信息依申請公開是政府信息公開制度的重要組成部分,我國政府信息公開以及政務公開工作起步較晚,但發(fā)展迅速。中共中央辦公廳,國務院辦公廳于2016年2月和11月先后印發(fā)了《關于全面推進政務公開工作的意見》,以及《關于全面推進政務公開工作的意見實施細則》,進一步明確了信息公開工作的未來發(fā)展方向。在信息公開的實踐過程中,依申請公開制度是實現(xiàn)公眾與行政機關互動的重要界面。廣大公眾與行政機關,不僅是信息依申請公開過程中互動關系的參與者,還都是這種關系的構建者。而在理論層面,伴隨著公共行政學科的發(fā)展,民主行政理論對公開性、回應性、參與性等民主價值的追求,成為公共行政實踐的重要精神內涵,這些價值構成了政府信息依申請公開背后的制度邏輯。而政府回應性和公眾參與性在制度實踐和價值實現(xiàn)過程中的統(tǒng)一,使得政府與公眾在依申請公開過程中的互動成為必然。反過來說,這種互動的良性發(fā)展,也是政府信息依申請公開制度實現(xiàn)其制度目標的必經之路。本文從民主行政理論的理論視角出發(fā),同時借助于信息空間理論在信息分類上的解釋,以及交往行為理論對互動行為的分析,著眼于政府信息依申請公開制度框架下的政民互動過程,首先構建了公眾與政府的完整互動界面。這一完整界面由三個相互聯(lián)系的子界面構成,分別以權利義務、制度程序和申請結果為互動核心。同時以訪談研究為主要研究方法,以公眾和行政機關兩個主體為研究對象,明確雙方的認知、需求、實踐模式等現(xiàn)狀,對其實踐場域內的互動現(xiàn)狀進行評析,發(fā)現(xiàn)我國現(xiàn)行的依申請公開制度,從制度設計到實踐過程,都未能完全貫徹互動性的要求。結合現(xiàn)狀,本文認為在未來的實踐過程中,政府和公眾雙方應該從轉變理念、完善規(guī)范、內外聯(lián)動、方法創(chuàng)新等方面助力政府信息公開工作。政府信息依申請公開過程,其制度本身就是以政府與公眾的互動性為本質要求的,但現(xiàn)有的研究卻未能全面的把握這種互動性,往往偏重于某一主體的行為特征來展開研究,并且傾向于分析公眾參與信息公開的可行性和現(xiàn)狀。本文則在民主行政等理論的視角下,以民主行政理論的回應性、參與性、公開性等價值維度為基礎,構建了政府與公眾在信息依申請公開過程中的不同互動層次,同時引入了公眾和政府兩個研究主體,更全面和清晰的把握了信息依申請公開的整體互動界面,通過對兩方在不同互動層次中的現(xiàn)狀分析,來發(fā)現(xiàn)癥結所在。
[Abstract]:Government information disclosure on application is an important part of government information disclosure system. Our government information disclosure and government affairs publicity work started relatively late, but the development is rapid. For the future. In the practice of information disclosure, the system of disclosure according to application is an important interface to realize the interaction between the public and the administrative organs. The general public and administrative organs are not only participants in the interactive relationship in the process of information disclosure according to application, but also the builders of this relationship. At the theoretical level, with the development of public administration, the pursuit of democratic values such as openness, responsiveness and participation in democratic administrative theory has become an important spiritual connotation of public administration practice. These values constitute the system logic behind the disclosure of government information according to the application. The unity of government responsiveness and public participation in the process of system practice and value realization makes the interaction between the government and the public in the process of opening up according to the application inevitable. On the other hand, this kind of positive development of interaction is also the only way for government information to realize its system goal. From the perspective of the theory of democratic administration, this paper, with the help of the explanation of information classification based on information space theory, and the analysis of interactive behavior by the theory of communicative behavior, Focusing on the process of the interaction between the government and the people under the framework of the open system of government information according to the application, the complete interaction interface between the public and the government is first constructed. This complete interface consists of three interlinked sub-interfaces, with rights and obligations, system procedures and application results as the core of interaction. At the same time, taking the interview research as the main research method, taking the public and the administrative organs as the research object, the paper clarifies the cognition, demand and practice mode of both sides, and evaluates the interaction situation in the practice field. It is found that the current system of disclosure according to application, from system design to practice, fails to fully implement the requirement of interactivity. Combined with the present situation, this paper holds that in the future practice process, both the government and the public should help the government to open information from the aspects of changing the idea, perfecting the norm, the internal and external linkage, the method innovation and so on. Government information is open according to the application process, its system itself is based on the interaction between the government and the public as the essential requirement, but the existing research has not fully grasped this interaction, often focusing on the behavior characteristics of a certain subject to carry out the research. And it tends to analyze the feasibility and current situation of public participation in information disclosure. From the perspective of democratic administration and other theories, based on the value dimensions of responsiveness, participation and openness of democratic administrative theory, this paper constructs different levels of interaction between the government and the public in the process of information disclosure according to the application. At the same time, it introduces two research subjects, the public and the government, more comprehensively and clearly grasps the whole interactive interface of the information open according to the application, and finds out the crux of the problem by analyzing the current situation of the two parties in different interaction levels.
