【摘要】： 解放戰(zhàn)爭時期,東北解放區(qū)是全國范圍內(nèi)最先得到全境解放的大行政區(qū)。在中共東北中央局和東北行政委員會的領(lǐng)導(dǎo)下,東北解放區(qū)的各級人民政權(quán)先后以條例、指示、辦法、布告等形式頒布了施政綱領(lǐng)及其他憲法性和法律性文件,為解放區(qū)的法制建設(shè)奠定了較為堅實的基礎(chǔ)；隨著東北解放戰(zhàn)爭的勝利發(fā)展和解放區(qū)的不斷擴大、鞏固,解放區(qū)逐步建立起各級司法機關(guān),逐步形成了比較完善的司法制度；創(chuàng)造了大規(guī)模改造犯罪分子的新形式和新經(jīng)驗。東北解放區(qū)的法制建設(shè),不僅對打擊敵人、懲治犯罪、保護人民起了重要作用,還對鞏固和發(fā)展解放區(qū)起了積極的作用。 筆者試圖在充分占有大量史料和已有卻較為零散的研究成果的基礎(chǔ)上,對解放戰(zhàn)爭時期的東北解放區(qū)法律制度進行梳理和探究,從而把握解放戰(zhàn)爭時期東北解放區(qū)法律制度的歷史演變過程及其發(fā)展規(guī)律。 本文闡述在解放戰(zhàn)爭時期的東北解放區(qū)法律制度建立的原因和理由,探討東北解放區(qū)法制建設(shè)在中國共產(chǎn)黨領(lǐng)導(dǎo)的新民主主義革命和統(tǒng)一全中國的斗爭中所產(chǎn)生的作用。 東北解放區(qū)的法制建設(shè)使我黨政權(quán)建設(shè)積累了寶貴經(jīng)驗,為建國后法制建設(shè)奠定了基礎(chǔ)。當(dāng)時的一些法律原則、概念、制度,今天仍在沿用,例如死刑復(fù)核制度、公開審判制度、人民陪審制度、再犯加重原則、司法獨立原則、法律面前人人平等原則、訴訟制度原則等,全面而系統(tǒng)地研究和探索解放戰(zhàn)爭時期的東北解放區(qū)的法制建設(shè),對于開展和推進我國今天的社會主義法制建設(shè)和政治體制改革具有重大的理論價值和實踐意義。
[Abstract]:During the liberation war, the Northeast liberated area was the first large administrative region to be liberated throughout the country. Under the leadership of the Northeast Central Bureau of the Communist Party of China and the Northeast Administrative Committee, the people's political power at all levels in the Northeast liberated areas successively promulgated a policy agenda and other constitutional and legal documents in the form of regulations, instructions, methods, notices, etc. With the successful development of the Northeast Liberation War and the unceasing expansion and consolidation of the liberated areas, the liberated areas gradually established judicial organs at all levels and gradually formed a relatively perfect judicial system. New forms and experiences have been created to transform criminals on a large scale. The construction of the legal system in the Northeast liberated areas not only plays an important role in attacking the enemy, punishing crimes and protecting the people, but also plays an active role in consolidating and developing the liberated areas. The author attempts to comb and explore the legal system of the Northeast liberated areas during the Liberation War on the basis of the full possession of a large number of historical data and the existing but scattered research results. In order to grasp the historical evolution of the legal system in the Northeast liberated areas during the Liberation War and its development law. This paper expounds the causes and reasons for the establishment of the legal system in the Northeast liberated areas during the War of Liberation, and probes into the role of the legal system in the Northeast liberated areas in the new democratic revolution led by the Communist Party of China and in the struggle to unify the whole of China. The construction of legal system in the Northeast liberated areas has accumulated valuable experience in the construction of our party's political power and laid a foundation for the legal construction after the founding of the people's Republic of China. Some of the legal principles, concepts and systems used at that time are still in use today, such as the death penalty review system, the open trial system, the people's jury system, the principle of aggravated recidivism, the principle of judicial independence, and the principle of equality before the law. To comprehensively and systematically study and explore the construction of the legal system in the Northeast liberated areas during the War of Liberation. It has great theoretical value and practical significance for carrying out and promoting the socialist legal system construction and political system reform in our country today.
