【摘要】：改革開放以來,建設(shè)有中國特色的社會(huì)主義事業(yè)取得了巨大的成就。政治、經(jīng)濟(jì)、文化體制的變革,引起了社會(huì)主體之間利益格局的重大調(diào)整和重組,這必然帶來人們價(jià)值觀念的變革與沖突,引發(fā)了利益結(jié)構(gòu)的變化和價(jià)值觀念的多樣化等一系列變化。從而使人們的道德價(jià)值標(biāo)準(zhǔn)和法律評(píng)判標(biāo)準(zhǔn)發(fā)生相應(yīng)的變化。 現(xiàn)代化加深了社會(huì)的分工與合作程度,社會(huì)結(jié)構(gòu)隨著社會(huì)環(huán)境的變化有了很大的調(diào)整。經(jīng)濟(jì)關(guān)系以及其他各種社會(huì)關(guān)系的復(fù)雜化,利益主體的多元化,使單一道德觀念和法制觀念失去了存在的土壤。傳統(tǒng)社會(huì)單一的社會(huì)結(jié)構(gòu)形成了單一的道德觀念和法制觀念。在現(xiàn)代社會(huì),分工系統(tǒng)得以發(fā)達(dá)和完善,社會(huì)結(jié)構(gòu)顯得多樣和復(fù)雜。社會(huì)結(jié)構(gòu)的復(fù)雜性引起了道德與法制關(guān)系的復(fù)雜性和道德與法制觀念的多樣性。而這種道德與法制觀念的變化正成為社會(huì)各界關(guān)注和爭議的熱點(diǎn),在此情況下討論如何建立一種有效的社會(huì)調(diào)控機(jī)制顯得尤為重要。因此,在新形勢下,如何喚起人們對(duì)法律的認(rèn)知、對(duì)道德的認(rèn)同,并且建立一套剛?cè)嵯酀?jì)、德法并舉的社會(huì)控制體系。不僅是理論界急待認(rèn)真探究的課題,而且毫無疑問有其積極的現(xiàn)實(shí)意義。 本文在社會(huì)控制的視角下,通過道德與法制兩種主要控制方法來構(gòu)建一種社會(huì)調(diào)控機(jī)制。對(duì)道德與法制的歷史發(fā)展?fàn)顩r、我國新時(shí)期的道德與法制建設(shè)以及社會(huì)控制中道德與法制可能面對(duì)的新問題進(jìn)行了深入剖析和探討。提出并闡述了解決新問題的一些對(duì)策與措施,研究具有重要的理論價(jià)值和積極的現(xiàn)實(shí)意義。
[Abstract]:Since the reform and opening up, the cause of building socialism with Chinese characteristics has made great achievements. The changes in political, economic and cultural systems have led to a major readjustment and reorganization of the pattern of interests among social subjects, which will inevitably bring about changes and conflicts in people's values. Has caused the interest structure change and the value idea diversification and so on a series of changes. In order to make people's moral value standards and legal evaluation standards corresponding changes. Modernization has deepened the social division of labor and cooperation, and the social structure has been greatly adjusted with the change of social environment. The complication of economic relations and other kinds of social relations and the diversification of interest subjects make the single moral and legal concepts lose the soil of existence. The single social structure of traditional society has formed a single moral and legal concept. In modern society, the division of labor system has been developed and improved, the social structure appears diverse and complex. The complexity of social structure leads to the complexity of the relationship between morality and legal system and the diversity of moral and legal concepts. However, the change of moral and legal concepts is becoming the focus of attention and controversy in the society. In this case, it is very important to discuss how to establish an effective social regulation and control mechanism. Therefore, in the new situation, how to arouse people's understanding of the law, to identify with morality, and to establish a set of social control system. Not only is the theory urgent to explore the subject, and there is no doubt its positive practical significance. From the perspective of social control, this paper constructs a kind of social control mechanism through two main control methods of morality and legal system. This paper makes a deep analysis and discussion on the historical development of morality and legal system, the construction of morality and legal system in the new period of our country and the new problems that may be faced by morality and legal system in social control. This paper puts forward and expounds some countermeasures and measures to solve the new problems. The research has important theoretical value and positive practical significance.
