【摘要】：律師既是民主政治的產(chǎn)物,也是社會(huì)經(jīng)濟(jì)的產(chǎn)物,而律師制度是現(xiàn)代國家法律制度的重要組成部分,律師權(quán)利的實(shí)現(xiàn)對一個(gè)國家的法治建設(shè)有著非常重要的影響。律師制度的健康發(fā)展,律師權(quán)利的充分實(shí)現(xiàn)對保障司法公正、保障人權(quán)方面都有無可替代的作用,而律師對一個(gè)國家實(shí)現(xiàn)法治的控權(quán)功能也是有著非常重要的作用。所以,律師業(yè)的發(fā)展往往是一個(gè)國家依法治國、法制健全的重要標(biāo)志。中國律師制度恢復(fù)以后,律師業(yè)有了很大的發(fā)展,律師隊(duì)伍不斷擴(kuò)大,律師素質(zhì)也不斷提高,律師執(zhí)業(yè)的制度環(huán)境和社會(huì)環(huán)境都有了很大的改善。但由于我國律師制度發(fā)展的歷史比較短以及我國政治、經(jīng)濟(jì)等因素,我國今天的律師業(yè)在飛速發(fā)展的同時(shí),仍然存在很多的問題。本文作者著重通過闡述分析中國律師業(yè)的現(xiàn)狀和存在的主要問題,以及律師對保障司法公正、保障人權(quán)和促進(jìn)法治建設(shè)等方面的作用,律師執(zhí)業(yè)對法治建設(shè)的重大影響,以期引起社會(huì)各界對律師業(yè)的關(guān)注,共同努力改善我國律師的執(zhí)業(yè)環(huán)境,讓我國律師業(yè)能夠持續(xù)健康的發(fā)展,從而為我國的法制建設(shè)作出應(yīng)有的更大的貢獻(xiàn)。
[Abstract]:Lawyer is not only the product of democratic politics, but also the product of social economy. The lawyer system is an important part of modern national legal system, and the realization of lawyer's right has a very important influence on the construction of a country's rule of law. The healthy development of the lawyer system and the full realization of the lawyer's rights play an irreplaceable role in the protection of judicial justice and human rights, and lawyers also play a very important role in the realization of the right to control the rule of law in a country. Therefore, the development of lawyers is often an important symbol of a country's rule of law and sound legal system. After the restoration of the lawyer system in China, the lawyer profession has developed greatly, the lawyer team has been expanded, the quality of the lawyer has been improved, and the system environment and the social environment of the lawyer practice have been greatly improved. However, due to the relatively short history of the development of China's lawyer system and the political and economic factors of our country, there are still many problems in the legal profession of our country at the same time of rapid development. The author focuses on the analysis of the current situation and main problems of China's lawyer industry, as well as the role of lawyers in safeguarding judicial justice, protecting human rights and promoting the construction of the rule of law, and the great influence of lawyer practice on the construction of the rule of law. It is hoped that all walks of life will pay attention to the legal profession, make joint efforts to improve the practice environment of lawyers in our country, and enable the legal profession of our country to develop continuously and healthily, thus making a greater contribution to the legal system construction of our country.
