【摘要】：在大數(shù)據(jù)時代,地理信息被廣泛地應(yīng)用于災(zāi)害預(yù)測、城市規(guī)劃、交通運輸、軍事部署、國防建設(shè)等領(lǐng)域,覆蓋了生產(chǎn)生活的方方面面。隨著互聯(lián)網(wǎng)科技發(fā)展和測繪技術(shù)提升,測繪成果已從傳統(tǒng)的圖紙資料逐步轉(zhuǎn)換成數(shù)字化信息數(shù)據(jù),地理信息的收集、使用、存儲和傳播等都變得方便快捷。隨之而來,泄密風(fēng)險日益增加,地理信息安全問題也變得更加突出,嚴重威脅了國家安全和個人信息安全。然而,我國并沒有構(gòu)建完整的地理信息安全法律制度,測繪立法更傾向于保護地理信息數(shù)據(jù),很少涉及對個人地理信息的保護。因此,本文從國家地理信息安全和個人地理信息安全兩個角度來探討如何完善我國地理信息安全法律制度。本文第一部分簡述了地理信息的概念、特征,并分別從國家信息安全和個人信息安全兩個角度介紹了危害地理信息安全的行為及地理信息安全重要性。第二部分主要闡述了我國國家地理信息安全和個人地理信息安全立法現(xiàn)狀,著重介紹了域外政府主導(dǎo)型、政府調(diào)控型、市場主導(dǎo)型管理模式下國家地理信息安全立法現(xiàn)狀,以及歐美發(fā)達國家個人地理信息安全立法現(xiàn)狀。第三部分重點分析了我國地理信息安全面臨的問題。在國家地理信息安全層面上存在著互聯(lián)網(wǎng)地圖泄密、保護觀念落后、保密定級標(biāo)準(zhǔn)不合理、立法滯后寬松、監(jiān)管執(zhí)法不力等不足;在個人地理信息安全層面面臨著谷歌街景對個人隱私侵犯、信息保護和利用間利益沖突、缺乏專門立法保護、法律救濟困難等難題。第四部分從國家信息安全和個人信息安全兩個維度探討如何完善我國地理信息安全法律制度,并提出了具體建議,包括確立國家地理信息安全監(jiān)管原則、構(gòu)建地理信息安全監(jiān)管機制、優(yōu)化地理信息安全等級評估、明確個人地理信息安全立法原則、確定個人地理信息主體權(quán)利、規(guī)定個人地理信息管理者義務(wù)、優(yōu)化司法救濟制度、強化執(zhí)法監(jiān)督等。
[Abstract]:In the era of big data, geographic information is widely used in disaster prediction, urban planning, transportation, military deployment, national defense construction and other fields, covering all aspects of production and life. With the development of Internet technology and the improvement of surveying and mapping technology, surveying and mapping achievements have been gradually converted from traditional drawing materials to digital information data. The collection, use, storage and dissemination of geographic information have become convenient and fast. With the increasing risk of leakage, the problem of geographic information security becomes more prominent, which seriously threatens the national security and personal information security. However, there is no complete legal system of geographic information security in our country. The legislation of surveying and mapping tends to protect geographic information data, and seldom involves the protection of personal geographic information. Therefore, this paper discusses how to perfect the legal system of geographic information security in our country from the two angles of national geographic information security and personal geographic information security. In the first part of this paper, the concept and characteristics of geographic information are briefly introduced, and the behaviors endangering geographic information security and the importance of geographic information security are introduced from two aspects of national information security and personal information security respectively. The second part mainly expounds the current situation of legislation on national geographic information security and personal geographic information security in China, focusing on the status quo of national geographic information security legislation under the mode of extraterritorial government leading, government regulation and market oriented management. And the European and American developed countries personal geographic information security legislation status quo. The third part focuses on the analysis of the problems of geographic information security in China. On the level of national geographic information security, there are some shortcomings, such as leakage of Internet map, backward concept of protection, unreasonable standard of classified secrecy, lax legislation, weak supervision and enforcement, etc. In the aspect of personal geographic information security, Google Street View is confronted with such problems as invasion of personal privacy, conflict of interest between information protection and utilization, lack of special legislative protection, difficulty of legal remedy, and so on. The fourth part discusses how to perfect the legal system of geographic information security in China from the two dimensions of national information security and personal information security, and puts forward some concrete suggestions, including establishing the principles of national geographic information security supervision. Constructing the supervision mechanism of geographic information security, optimizing the evaluation of geographic information security grade, clarifying the legislative principle of personal geographic information security, determining the rights of personal geographic information subject, stipulating the duties of personal geographic information managers, optimizing the judicial relief system. Strengthen the supervision of law enforcement, etc.
