【摘要】：推進(jìn)權(quán)力清單制度的實(shí)施,是法治政府建設(shè)下中央政府的施政重點(diǎn),是規(guī)范權(quán)力運(yùn)行、維護(hù)公民權(quán)利的重要舉措。權(quán)力清單制度的實(shí)施,以法治理念為指導(dǎo),以依法辦事為手段,對政府及其工作人員樹立并強(qiáng)化法治意識具有重要意義。同時,實(shí)施權(quán)力清單制度可以明確權(quán)力界限,優(yōu)化權(quán)責(zé)配置,提高行政效率,提高治理能力,確保依法行政,建設(shè)法治政府。隨著權(quán)力清單制度在各地的全面推行,社會公眾給予了高度的贊賞。但是改革勢必不會一蹴而就,由于在推行權(quán)力清單過程中涉權(quán)各方思想意識的問題,再加上長久以來固有的公共管理思維局限,讓權(quán)力清單制度的推進(jìn)阻力重重。權(quán)力清單制度還需進(jìn)一步在實(shí)踐中探索完善。論文通過運(yùn)用文獻(xiàn)研究法,系統(tǒng)地梳理了國內(nèi)外關(guān)于權(quán)力制約與監(jiān)督的研究情況,并將相關(guān)理論呈現(xiàn)出來,以期為推進(jìn)權(quán)力清單制度提供理論依據(jù)。在建設(shè)法治政府的背景下,筆者運(yùn)用案例分析的方法,通過對陜西省咸陽市政府及相關(guān)部門推行權(quán)力清單制度的實(shí)踐進(jìn)行研究和探討,明確了權(quán)力清單制度推行過程中所遇到的問題,包括政府公職人員法治思維和主觀能動性不足、權(quán)力清單出現(xiàn)其他兜底權(quán)力、公眾參與不足和公開透明度不高等問題,在此基礎(chǔ)上,筆者分析出導(dǎo)致這些問題的原因,即傳統(tǒng)政治文化的影響、相關(guān)行政法律法規(guī)不夠完善、監(jiān)督主體和形式單一、權(quán)力清單制度運(yùn)行的技術(shù)支撐尚未成熟等,并進(jìn)一步探索出有利于地方政府推行權(quán)力清單制度的路徑。最后,論文嘗試性地提出了推動權(quán)力清單制度實(shí)施的對策,主要包括轉(zhuǎn)變涉權(quán)各方思想觀念、配套健全相關(guān)法律制度、提高公民社會參與度、完善相關(guān)技術(shù)支撐等方面,試圖為咸陽市政府、乃至地方政府權(quán)力清單制度實(shí)施的法治化建設(shè)提供多元思路和有益參考。
[Abstract]:The implementation of the power list system is the key point of the central government under the construction of the rule of law. It is an important measure to standardize the operation of power and safeguard the rights of citizens. The implementation of the system of power list is of great significance to the government and its staff members to strengthen the consciousness of the rule of law and to strengthen the consciousness of the rule of law by the rule of law. The implementation of the power list system can clear the limits of power, optimize the allocation of power and responsibility, improve the administrative efficiency, improve the governance capacity, ensure the administration by law, and build the government under the rule of law. With the full implementation of the power list system in all places, the public is highly appreciated. But the reform will not be achieved overnight, due to the implementation of the list of power. The issue of the ideological consciousness of the parties involved in the process, coupled with the inherent limitations of the public management thinking for a long time, makes the system of power list more resistance. The power list system needs to be further explored and perfected in practice. By using the literature research method, the paper systematically combs the Research on power restriction and supervision at home and abroad. In the context of building a government under the rule of law, the author uses the method of case analysis to study and discuss the practice of carrying out the power list system in Xianyang municipal government and related departments of Shaanxi Province, and clarifies the process of the implementation of the power list system. The problems encountered, including the government officials' rule of law thinking and subjective initiative, other power lists, lack of public participation and public transparency are the reasons for these problems, that is, the influence of the traditional political culture, the lack of the relevant administrative laws and regulations, and the supervision of the relevant administrative laws and regulations. The subject and form of the governor and the form are single, the technical support of the operation of the power list system is not mature, and further explores the way for the local government to carry out the system of power list. Finally, the paper attempts to put forward the countermeasures to promote the implementation of the power list system, including the ideas of the parties involved in the transfer of power and the relevant laws and relevant laws. The system, the improvement of citizen's social participation and the improvement of relevant technical support, try to provide multiple ideas and useful references for the construction of the rule of law in the implementation of the power list system of Xianyang municipal government and even the local government.
