【摘要】：在"堅持法治國家、法治政府、法治社會一體建設(shè)"的語境下,"法治社會"應(yīng)作狹義理解,即民間社會或市民社會成員權(quán)利及其行使的法治化,以及私人領(lǐng)域事務(wù)治理和社會成員參與公共事務(wù)活動的規(guī)則化、法治化的社會狀態(tài)。法治社會建設(shè)實踐有助于提升成熟的法治社會對社會成員的品質(zhì)要求——強烈的主人意識和科學(xué)的法治精神,同時能為法治中國的建設(shè)輸送合格建設(shè)者;但中國市民社會歷史傳統(tǒng)的缺乏、難以把控自治組織松緊度的現(xiàn)實困境以及國人目前所擁有的對己不利規(guī)則意識的水準(zhǔn),嚴(yán)重制約著中國法治社會的建設(shè)。為此,應(yīng)該在全社會強力實施以利益均衡為內(nèi)核的誠信教育,推動誠信建設(shè)適度法治化,積極引導(dǎo)扶持社會自治實踐。
[Abstract]:In the context of "adhering to the rule of law, the government under the rule of law, and the building of a society under the rule of law", the "rule of law society" should be understood in a narrow sense, that is, the rule of law of the rights and exercises of the members of civil society or civil society, as well as the regularization of private sector affairs and the participation of social members in public affairs, the rule of law society and the social construction of the rule of law. Practice helps to improve the quality requirements of the mature rule of law for the quality of the members of the society - a strong sense of master and the spirit of the rule of law in the rule of law. At the same time, it can deliver qualified builders for the construction of the rule of law in China. However, the lack of the historical tradition of the Chinese civil society is difficult to bring about the realistic predicament of controlling the autonomy of the autonomous organization and the current ownership of the Chinese. The level of consciousness of disadvantageous rules seriously restricts the construction of the rule of law in China. Therefore, it is necessary to implement the good faith education with the balance of interests as the core in the whole society, to promote the moderate legalization of the construction of good faith, and to actively guide the practice of supporting social autonomy.
