【摘要】：中國作為農業(yè)大國擁有相當大比例的農民,搞好村民自治制度有利我國基層民主建設,也會為我國的法制建設起到巨大的推動作用。村民自治制度在共產黨的領導下取得了令人矚目的成就,對農村的政治、經濟、民主法治建設甚至是整個國家的發(fā)展都有著深遠的進步意義。村民自治的出現一方面是在憲法體制下出現演化和發(fā)展的,另一方面是由于我國農村具有深厚封建主義和小農意識的背景,這種背景導致了我國村民自治制度的建設有許多自己的特點及問題。村民自治制度要求村民通過民主選舉、民主管理、民主決策、民主監(jiān)督實現村民的民主權利�！稇椃ā放c《村民委員會組織法》是村民自治制度的主要的法律依據,但是在實際應用中卻出現了很多問題,本文通過研究村民自治的特征、構成要件方式和內容以及村民自治的基本原則等基本概況,并通過分析典型案例探討研究村民自治制度出現的各種問題,最后提出完善村民自治制度及相關法律的相應對策。推動村民自治制度的發(fā)展也相當于推動我國民主法治的發(fā)展。本文研究內容由五部分組成:第一部分主要就選題背景及研究意義、研究思路與方法和憲法學研究及意義等三個方面的內容做了論述。第二部分主要就村民自治制度的概念與特征,村民自治的構成要件、村民自治制度的內容與方式和村民自治的基本原則四方面內容進行論述。第三部分論述了村民自治的現狀及出現的諸多問題,包括村民選舉中出現的各類問題,村民委員會與村黨支部之間的矛盾,鄉(xiāng)鎮(zhèn)政府過度干預問題以及救濟的欠缺等問題。第四部分主要論述村民自治制度的完善,如何解決上一部分所提出的各類問題,并能提出更好的建議以完善村民自治制度,使村民自治制度進展的更加順利。第五部分是結語部分,主要是對村民自治制度未來的發(fā)展做出展望,為我國民主法治建設的發(fā)展上發(fā)揮更大的價值。
[Abstract]:As a large agricultural country, China has a large proportion of farmers. Doing a good job of villager autonomy system is beneficial to the construction of democracy at the grass-roots level in our country, and will also play a great role in promoting the construction of our country's legal system. Under the leadership of the Communist Party, the villager autonomy system has made remarkable achievements, and has far-reaching progress significance to the rural politics, economy, the construction of democracy and the rule of law, and even the development of the whole country. On the one hand, the emergence of villager autonomy is due to the evolution and development under the constitutional system, on the other hand, because of the deep feudalism and smallholder consciousness in the countryside of our country, This background has led to many characteristics and problems in the construction of villager autonomy system in China. The system of villagers' autonomy requires villagers to realize their democratic rights through democratic election, democratic management, democratic decision-making and democratic supervision. The Constitution and the Organic Law of villagers' Committees are the main legal basis for the system of villagers' autonomy. However, there are many problems in the practical application. This paper studies the characteristics of villagers' autonomy, the form and content of the elements, and the basic principles of villagers' autonomy, and so on. Through the analysis of typical cases, this paper discusses the problems of villager autonomy system, and finally puts forward the corresponding countermeasures to perfect the villager autonomy system and related laws. Promoting the development of villager autonomy system is also equivalent to promoting the development of democracy and rule of law in our country. The content of this paper is composed of five parts: the first part mainly discusses the background and significance of the topic, the research ideas and methods, and the research and significance of constitutional jurisprudence. The second part mainly discusses the concept and characteristics of villager autonomy system, the constituent elements of villager autonomy, the content and method of villager autonomy system and the basic principles of villager autonomy. The third part discusses the present situation and many problems of villager autonomy, including the various problems in the villagers' election, the contradiction between the villagers' committee and the village party branch, the excessive intervention of the township government and the lack of relief and so on. The fourth part mainly discusses the perfection of the villagers' autonomy system, how to solve the various problems raised in the previous part, and can put forward better suggestions to perfect the villagers' autonomy system and make the progress of the villagers' autonomy system more smooth. The fifth part is the conclusion part, mainly makes the prospect to the villagers autonomy system future development, for our country democracy rule of law construction development to play the greater value.
