中國法治建設(shè)中儒家倫理對法治進(jìn)程的影響

【摘要】: 儒家倫理作為一種民族心理、作為一種思想傳統(tǒng),儒家倫理在法治進(jìn)程中的影響力無疑也是持續(xù)的。由于“德治”是中國傳統(tǒng)儒家所倡導(dǎo)的治理模式,而且這一傳統(tǒng)對“依法治國”已經(jīng)成為一種共識的今天,仍然具有強(qiáng)大的影響,因此,把握傳統(tǒng)儒家的“德治”,以及德治與法治的之間的關(guān)系,對我們在學(xué)習(xí)借鑒西方近現(xiàn)代法制基礎(chǔ)上的法制現(xiàn)代化,無疑都具有很強(qiáng)的理論和現(xiàn)實(shí)意義。首先,本文先論述中國傳統(tǒng)儒家倫理德治思想的基本內(nèi)涵,以及“德治”與“法治”的關(guān)系,并以一種歷史的視角說明儒家關(guān)于倫理與法、德治與法治關(guān)系在前秦時(shí)期、秦漢至宋、宋至清末的歷史演進(jìn)。隨后,本文闡述了傳統(tǒng)德治的近現(xiàn)代境遇。自1840年鴉片戰(zhàn)爭開始,傳統(tǒng)儒家德治思想開始受到?jīng)_擊,傳統(tǒng)德治思想的發(fā)展也與移植的法律制度之間發(fā)生了沖突。最后本文通過分析我國目前法治的困境,論證了我國法治進(jìn)程不能單純的移植西方法律制度,還應(yīng)該體現(xiàn)我國傳統(tǒng)的倫理價(jià)值。
[Abstract]:Confucian ethics as a kind of national psychology, as a tradition of thought, Confucian ethics in the process of rule of law is undoubtedly sustained. Because "rule by virtue" is the governance mode advocated by Chinese traditional Confucianism, and this tradition has become a common understanding of "rule by law", it still has a strong influence, so, grasp the "rule of virtue" of traditional Confucianism, There is no doubt that the relationship between the rule of virtue and the rule of law is of great theoretical and practical significance for us to learn from the modernization of the legal system on the basis of modern western legal system. First of all, this paper first discusses the basic connotation of Chinese traditional Confucian ethical rule of virtue, and the relationship between "rule of virtue" and "rule by law", and explains the relationship between ethics and law, rule by virtue and rule by law of Confucianism in the pre-Qin period from a historical perspective. The historical evolution from the Qin and Han dynasties to the Song Dynasty and from the Song Dynasty to the late Qing Dynasty. Then, this article elaborated the modern situation of the traditional rule of virtue. Since the Opium War of 1840, the traditional Confucian thought of rule of virtue began to be impacted, and the development of the traditional thought of rule of virtue also conflicted with the transplanted legal system. Finally, by analyzing the predicament of the rule of law in our country, this paper demonstrates that the process of the rule of law in our country should not only transplant the western legal system, but also embody the traditional ethical value of our country.
