【摘要】：專家參與立法是近年來在地方立法實踐中被反饋為效果較好的一種公眾參與形式,專家參與立法能夠在多個領(lǐng)域為立法工作創(chuàng)造多種價值,有利于促進(jìn)民主立法的實現(xiàn)。目前我國專家參與地方立法活動中仍然存在一些問題,包括法律定位不清、利益表達(dá)機(jī)制不充分、保障措施不完善等,可能會影響到專家參與立法良好效果的實現(xiàn)。因此,需要對相關(guān)立法進(jìn)行完善,建立良好的利益表達(dá)機(jī)制和監(jiān)督機(jī)制,同時提供制度和物質(zhì)保障,進(jìn)一步為專家參與地方立法提供良好的制度支持。
[Abstract]:Expert participation in legislation is a form of public participation which has been feedback in the practice of local legislation in recent years. Expert participation in legislation can create a variety of values for legislative work in many fields and is conducive to the realization of democratic legislation. At present, there are still some problems in the participation of experts in local legislative activities, including unclear legal position, inadequate mechanism of interest expression, imperfect safeguard measures and so on, which may affect the realization of good effect of expert participation in legislation. Therefore, it is necessary to perfect the relevant legislation, establish a good mechanism of interest expression and supervision, provide system and material protection, and further provide good institutional support for experts to participate in local legislation.
