【摘要】：20世紀80年代末,中國的行政聽證制度得以確立并取得較快發(fā)展,作為行政聽證的重要內容之一,公共項目聽證也越來越引起社會的廣泛重視。在關系到公民切身利益的公共項目決策中引入聽證制度,既是決策民主化的內在要求,也是保障公共利益、實現公共項目公平性、公開性、科學性的重要途徑。 聽證制度的本意在于集結民意、協(xié)調利益,以公民權力制約行政權力,其本身就蘊含協(xié)商民主的機理,提供了協(xié)商的平臺。因此,從協(xié)商民主的角度探討公共項目聽證,不僅體現了聽證的內在價值,也是一個新的研究視角。 協(xié)商民主理論強調,在多元社會現實的背景下,公民通過行使平等的話語權,自由、開放地參與公共決策,在對話、辯論、協(xié)商中達成共識,為政府決策提供價值性的規(guī)導,以維護和實現公共利益。本文的分析以此為出發(fā)點,通過分析不同的商談類型,指出趨向于實用性商談的公共項目聽證的特征及發(fā)展方向；通過典型案例論述公共項目聽證在我國的實施狀況,并分析其在實踐中存在的問題。最后,通過將協(xié)商民主思想與聽證更深入的結合,審視中國公共項目聽證的發(fā)展,以期在協(xié)商民主的基礎上對公共項目聽證發(fā)展中的問題進行深入的思考,進而為公共項目決策聽證制度的構建完善提供可行的途徑。
[Abstract]:At the end of the 1980s, the administrative hearing system of China was established and developed rapidly. As one of the important contents of the administrative hearing, public project hearing has attracted more and more attention from the society. The introduction of hearing system in public project decision-making related to the vital interests of citizens is not only the inherent requirement of the decision democratization, but also the guarantee. It is an important way to prevent public interests from achieving fairness, openness and scientificity in public projects.
The intention of the hearing system is to gather the public opinion, coordinate the interests and restrict the administrative power by civil power. It itself contains the mechanism of consultation democracy and provides a platform for consultation. Therefore, the discussion of public item hearing from the perspective of consultative democracy not only embodies the intrinsic value of the hearing, but also a new perspective of research.
The theory of consultative democracy emphasizes that, under the background of multiple social reality, citizens can achieve common understanding in dialogue, debate and negotiation through the exercise of equal right of discourse, free and open participation in public decision-making, and provide values for government decision-making, in order to maintain and realize public interest. This analysis is based on the analysis of different merchants. To discuss the characteristics and development direction of public item hearing which tends to be practical and talk about; discuss the implementation status of public project hearing in our country through typical cases, and analyze its problems in practice. Finally, through a more thorough combination of consultative democratic thought and hearing, it examines the development of public project hearing in China. On the basis of consultative democracy, we should think deeply about the problems in the development of public project hearing, and then provide a feasible way for the construction and improvement of the public project decision hearing system.
