【摘要】： 隨著世界范圍內(nèi)民主浪潮的興起,人民對民主的呼聲越來越高,民主行政成為行政改革實(shí)踐的必然。我國社會主義市場經(jīng)濟(jì)不斷向前發(fā)展,公民的民主意識日益增強(qiáng),為了維護(hù)人民的主人翁地位,保護(hù)公民的民主權(quán)利,必須加強(qiáng)制度建設(shè),使民主制度化、法制化,使社會主義民主行政有切實(shí)的制度保障,以此實(shí)現(xiàn)公共權(quán)力的規(guī)范化和公共利益的最大化。 在我國,民主行政制度化尚屬一個較新的研究課題。民主行政制度化是指針對當(dāng)前民主行政制度的缺位和不完善,強(qiáng)調(diào)在制度層面作出積極回應(yīng),就是把民主行政的內(nèi)容、形式和渠道等方面以制度的形式固定下來,用制度來體現(xiàn)、鞏固、維護(hù)和發(fā)展民主,使行政管理活動有法可依、有章可循。 本文以制度化的視角采用系統(tǒng)分析方法及文獻(xiàn)分析方法研究我國民主行政的發(fā)展,重點(diǎn)關(guān)注其制度化進(jìn)程。本文共分為四個部分,首先介紹了民主行政制度化的選題背景及研究方法,通過對國內(nèi)外文獻(xiàn)綜述闡述民主行政制度化的國內(nèi)外研究現(xiàn)狀；其次進(jìn)行了一系列理論研究,以民主行政理論、制度學(xué)理論及治理理論為理論依據(jù),運(yùn)用管理學(xué)、行政學(xué)、法學(xué)等學(xué)科的基礎(chǔ)原理,界定了民主行政制度化的概念,并指出實(shí)現(xiàn)民主行政制度化的必要性；接著對我國民主行政制度化進(jìn)程進(jìn)行總結(jié),介紹我國民主行政制度化所取得的初步成效,同時也指出其在發(fā)展過程中存在的問題并進(jìn)行原因分析；最后從實(shí)現(xiàn)我國民主行政制度化的途徑出發(fā),結(jié)合中國實(shí)際情況,提出強(qiáng)化民主行政制度化理念、加大制度創(chuàng)新的力度、完善民主行政的具體制度、提高民主行政制度的執(zhí)行力和加強(qiáng)相應(yīng)的法律保障等推進(jìn)我國民主行政制度化的對策。
[Abstract]:With the rise of the wave of democracy in the world, the voice of the people for democracy is becoming higher and higher, democratic administration becomes the inevitable practice of administrative reform. China's socialist market economy is constantly developing and citizens' democratic consciousness is growing. In order to safeguard the people's status as masters and protect citizens' democratic rights, we must strengthen the construction of institutions, institutionalize and legalize democracy. In order to realize the standardization of public power and the maximization of public interest, the socialist democratic administration has practical system guarantee. In China, the institutionalization of democratic administration is still a relatively new research topic. The institutionalization of democratic administration means that in view of the absence and imperfection of the current democratic administrative system, the emphasis on making a positive response at the institutional level is to stabilize the contents, forms and channels of democratic administration in the form of the system. Use system to embody, consolidate, maintain and develop democracy, so that administrative activities have laws to abide by and rules to follow. This paper studies the development of democratic administration in China from the perspective of systematization and literature analysis, and focuses on the process of institutionalization. This paper is divided into four parts. Firstly, it introduces the background and research methods of democratic administration institutionalization, and expounds the domestic and foreign research status of democratic administration institutionalization through literature review at home and abroad, and then carries out a series of theoretical studies. Based on the theory of democratic administration, institutional theory and governance theory, and applying the basic principles of management, administration and law, this paper defines the concept of democratic administration institutionalization, and points out the necessity of realizing democratic administration institutionalization. Secondly, it summarizes the process of the institutionalization of democratic administration in our country, introduces the initial achievements of the institutionalization of democratic administration in our country, and points out the problems existing in the process of its development and analyzes the reasons. Finally, starting from the way of realizing the institutionalization of democratic administration in our country, combining with the actual situation in China, this paper puts forward the idea of strengthening the institutionalization of democratic administration, strengthening the strength of system innovation, and perfecting the concrete system of democratic administration. The countermeasures to promote the institutionalization of democratic administration in China are to improve the executive power of democratic administrative system and strengthen the corresponding legal guarantee.
