【摘要】：本文擬在國(guó)家—社會(huì)的基本分析框架基礎(chǔ)上,從現(xiàn)代國(guó)家和現(xiàn)代社會(huì)建構(gòu)的角度出發(fā),對(duì)我國(guó)基層民主的發(fā)展歷程和制度建設(shè)進(jìn)行橫向?qū)Ρ群涂v向梳理,結(jié)合基層民主發(fā)展中遇到的現(xiàn)實(shí)問(wèn)題,得出結(jié)論：權(quán)利保障是我國(guó)基層民主下一階段發(fā)展的新趨向。 文章從基層民主的五個(gè)主要領(lǐng)域里權(quán)利保障的發(fā)展?fàn)顩r和制度建構(gòu)入手,結(jié)合基層社會(huì)中的熱點(diǎn)現(xiàn)象,探討當(dāng)前形勢(shì)下基層民主發(fā)展中制約權(quán)利保障運(yùn)行的因素和問(wèn)題,對(duì)這些缺陷和不足提出可行性建議,探討通過(guò)構(gòu)建更加完善的基層民主制度和權(quán)利保障運(yùn)行機(jī)制,使得基層民主發(fā)展和權(quán)利保障良性互動(dòng),協(xié)調(diào)發(fā)展。 改革開(kāi)放以來(lái)經(jīng)過(guò)長(zhǎng)期的制度積累和廣泛實(shí)踐,我國(guó)基層民主建設(shè)在保障公民權(quán)利方面取得了巨大的成就,民主內(nèi)容和形式日益創(chuàng)新和豐富,民主參與機(jī)制和制度構(gòu)建日益完善和健全,既推動(dòng)了我國(guó)社會(huì)主義民主的發(fā)展,又鍛煉了人民群眾的參政能力,落實(shí)和保障了群眾的民主權(quán)利。與此同時(shí)我們也應(yīng)該認(rèn)識(shí)到基層民主的發(fā)展是一個(gè)不斷探索和實(shí)踐的過(guò)程,不可能一蹴而就。我國(guó)基層民主在現(xiàn)階段存在一些問(wèn)題制約著公民權(quán)利的保障,同時(shí)也限制了基層民主的進(jìn)一步完善和發(fā)展。通過(guò)民主社會(huì)培育、構(gòu)建國(guó)家民主政治,賦權(quán)于公民,并不意味著公民便能真正享有這些權(quán)利,沒(méi)有保障的權(quán)利便等于沒(méi)有權(quán)利。在國(guó)家賦權(quán)之后,更加需要構(gòu)建完善的、健全的、有力的權(quán)利保障機(jī)制來(lái)保障這些權(quán)利的享有和落實(shí),這也將推動(dòng)基層民主發(fā)展。
[Abstract]:On the basis of the basic analysis frame of the state and society, this paper, from the angle of the construction of modern country and modern society, makes a horizontal contrast and vertical combing of the development course and system construction of our country's grass-roots democracy. Combined with the practical problems encountered in the development of grass-roots democracy, it is concluded that the guarantee of rights is the new trend of the development of grass-roots democracy in the next stage. Starting with the development and system construction of the right guarantee in the five main fields of grass-roots democracy, this paper discusses the factors and problems that restrict the operation of the right guarantee in the development of grass-roots democracy under the current situation, combining with the hot spot phenomenon in the grass-roots society. This paper puts forward some feasible suggestions on these defects and deficiencies, and probes into how to establish a more perfect grass-roots democratic system and the operation mechanism of right guarantee, so as to make the grass-roots democratic development and rights guarantee interact with each other and develop harmoniously. After a long period of institutional accumulation and extensive practice since the reform and opening up, China's grass-roots democratic construction has made great achievements in safeguarding the rights of its citizens, and the contents and forms of democracy have become increasingly innovative and rich. The construction of democratic participation mechanism and system not only promotes the development of socialist democracy in our country, but also exercises the people's ability to participate in politics, and implements and guarantees the democratic rights of the masses. At the same time, we should realize that the development of grass-roots democracy is a process of continuous exploration and practice, which cannot be achieved overnight. There are some problems in our country's grass-roots democracy at the present stage, which restrict the protection of citizens' rights, and also restrict the further improvement and development of grass-roots democracy. The cultivation of democratic society, the construction of national democratic politics and the empowerment of citizens do not mean that citizens can really enjoy these rights. After the country is empowered, it is necessary to construct perfect, sound and powerful rights guarantee mechanism to guarantee the enjoyment and implementation of these rights, which will also promote the development of democracy at the grass-roots level.
