習(xí)慣法在當(dāng)代中國法制進程中的角色扮演

【摘要】:為了對習(xí)慣法的概念作出科學(xué)的界定,并明確習(xí)慣法在當(dāng)代中國法制進程中的作用,本文以馬克思主義唯物辯證法指導(dǎo),同時運用歷史分析的方法、比較的方法、理論與實證相結(jié)合的方法,對習(xí)慣法的生成、演進、習(xí)慣法的法源地位、習(xí)慣法和國家法的關(guān)系、習(xí)慣法在當(dāng)代中國法制進程中的作用進行了科學(xué)的研究。 目前國內(nèi)學(xué)者對習(xí)慣法概念的界定可以說是仁者見仁,智者見智,大家對習(xí)慣法概念的認(rèn)識并不統(tǒng)一,但這并不影響我們在比較確定的范圍內(nèi)對習(xí)慣法概念進行界定。本文通過比較研究的方法,并結(jié)合政治學(xué)、哲學(xué)、人類學(xué)的相關(guān)理論,將習(xí)慣法界定為獨立于制定法之外的,在一定領(lǐng)域或地域的長期社會生活中逐漸形成的,調(diào)整當(dāng)事人權(quán)利義務(wù)關(guān)系的具有一定強制性的行為規(guī)范總和。本文還論證了習(xí)慣法作為正式法源的合理性與合法性。 在習(xí)慣法和法制的關(guān)系上,本文認(rèn)為,自從國家法產(chǎn)生以來,社會就進入了二元社會秩序形態(tài),表現(xiàn)為以習(xí)慣法主導(dǎo)的社會秩序和以制定法主導(dǎo)的社會秩序共同存在。在當(dāng)今中國,隨著市場經(jīng)濟的深入發(fā)展,建設(shè)社會主義法制國家已成為治國理政的基本方略,在這種情形下,習(xí)慣法規(guī)則幾乎處在被邊緣化的地位,因而,對民俗習(xí)慣的價值功能的忽視,也就合乎常理。但是社會的復(fù)雜性與社會調(diào)整體系的多元性決定了法律只能作為社會調(diào)整體系中的基本的、主要規(guī)則體系,而不是,也不可能是唯一的規(guī)則體系。通過對習(xí)慣法和國家法關(guān)系的研究,本文認(rèn)為,在法制現(xiàn)代化進程中,國家制定法不能簡單的宣布習(xí)慣法無效或者強行以法律取代習(xí)慣法,而應(yīng)該對習(xí)慣法進行揚棄,積極吸收習(xí)慣法中有價值、有利于推進法制現(xiàn)代化進程的因素,同時,我們也要剔除習(xí)慣法中不適應(yīng)社會化大生產(chǎn)的成分、不合理的落后的因素,剔除違背憲法和法律精神的習(xí)慣法。
[Abstract]:In order to define the concept of customary law scientifically and clarify the role of customary law in the process of legal system in contemporary China, this paper uses Marxist materialist dialectics to guide, at the same time, the method of historical analysis and the method of comparison. By combining theory with practice, this paper makes a scientific study on the formation and evolution of customary law, the legal source status of customary law, the relationship between customary law and national law, and the role of customary law in the process of legal system in contemporary China. At present, the definition of the concept of customary law by domestic scholars can be said to be benevolent, different wisdom, everyone's understanding of the concept of customary law is not uniform, but this does not affect us to define the concept of customary law in a more definite scope. In this paper, by means of comparative study and combining with the relevant theories of politics, philosophy and anthropology, we define customary law as one which is formed gradually in the long-term social life of a certain field or region, independent of the statutory law. Regulating the relationship between the rights and obligations of the parties has a certain mandatory behavior norms. This paper also demonstrates the rationality and legality of customary law as a formal source of law. In the relationship between customary law and legal system, this paper holds that since the emergence of national law, the society has entered the dual social order, which is manifested by the existence of the social order dominated by customary law and the social order dominated by statutory law. In today's China, with the further development of the market economy, building a socialist legal state has become the basic strategy of governing the country. In this case, the customary law rules are almost marginalized, so, It is reasonable to ignore the value function of folklore. However, the complexity of society and the diversity of social adjustment system determine that the law can only be regarded as the basic, main rule system in the social adjustment system, and not, it can not be the only rule system. Through the study of the relationship between customary law and national law, this paper holds that in the process of modernization of the legal system, the state law should not simply declare the customary law null or void or force the law to replace the customary law, but should sublate the customary law. Actively absorbing the valuable elements of customary law is conducive to promoting the modernization of the legal system. At the same time, we should also remove elements of customary law that are not suitable for socialized mass production and that are unreasonably backward. The removal of customary law that is contrary to the spirit of the Constitution and the law.
