【摘要】：法治思想是休謨政治社會(huì)理論的重要組成部分,卻長(zhǎng)期沒(méi)能得到足夠重視。休謨?yōu)榉ㄖ翁峁┝嘶谌祟愋袨樘卣鞯姆ㄕ軐W(xué)論證。他認(rèn)為法治的正當(dāng)性基礎(chǔ)在于,它是人們?cè)谘莼┺倪^(guò)程中對(duì)集體合作困境破解的結(jié)果。政府的使命就是捍衛(wèi)和實(shí)施規(guī)則。在法哲學(xué)思考以及對(duì)英國(guó)歷史考察的基礎(chǔ)上,休謨對(duì)法治保護(hù)私人產(chǎn)權(quán)、限制政府權(quán)力、具備形式要素等三重內(nèi)涵進(jìn)行了闡釋。休謨的法治思想在世俗主義的基礎(chǔ)上對(duì)法律至上原則予以重申、順應(yīng)了商業(yè)社會(huì)發(fā)展的趨勢(shì)與時(shí)代主題,為底線法治實(shí)質(zhì)主義提供了哲學(xué)心理學(xué)的辯護(hù)。休謨是現(xiàn)代保守主義法治思想傳統(tǒng)的先驅(qū),其思想是人們深入理解法治觀念的重要資源。
[Abstract]:The thought of rule of law is an important part of Hume's political and social theory, but has not been paid enough attention to for a long time. Hume provides legal philosophy argumentation based on the characteristics of human behavior for the rule of law. He believes that the legitimacy of the rule of law lies in that it is the result of solving the dilemma of collective cooperation in the evolutionary game. The government's mission is to defend and enforce the rules. On the basis of the philosophical thinking of law and the study of British history, Hume explained the triple connotation of the rule of law to protect private property rights, to restrict government power and to possess formal elements. Hume's thought on the rule of law restates the principle of the supremacy of law on the basis of secularism, conforms to the trend of the development of commercial society and the theme of the times, and provides a philosophical psychology defense for the bottom line of the essence of the rule of law. Hume is the forerunner of modern conservative thought of rule of law, whose thought is an important resource for people to deeply understand the concept of rule of law.
