從次貸危機(jī)析我國(guó)離岸金融監(jiān)管法制的完善

【摘要】:離岸金融是高度國(guó)際化、自由化的產(chǎn)物,憑借其高效率、高回報(bào)的融資功能,短短半個(gè)世紀(jì)已發(fā)展成為現(xiàn)代金融的重要組成部分,在國(guó)際金融競(jìng)爭(zhēng)中發(fā)揮著重要作用。但離岸金融是把雙刃劍,由于其兩頭在外的特征,與在岸金融相比其金融風(fēng)險(xiǎn)被明顯放大,相應(yīng)地也加大了監(jiān)管的難度。 歷史的實(shí)踐證明,金融改革總是與金融危機(jī)相伴而生,在這次由次貸引發(fā)的金融危機(jī)中,美國(guó)、德國(guó)、英國(guó)等紛紛對(duì)自己的金融監(jiān)管法制進(jìn)行改革,同時(shí)指出離岸金融中心在金融危機(jī)中發(fā)揮了不可小視的作用。 我國(guó)離岸金融起步二十年有余,與美國(guó)、馬來(lái)西亞等相比,法制建設(shè)明顯落后,在監(jiān)管理念、監(jiān)管模式、業(yè)務(wù)監(jiān)管制度、風(fēng)險(xiǎn)監(jiān)管制度、退出監(jiān)管制度等方面存在諸多缺陷,是阻礙我國(guó)離岸金融市場(chǎng)建設(shè)的重要因素。因此,我們要全面參與到國(guó)際金融競(jìng)爭(zhēng)中并爭(zhēng)取國(guó)際金融秩序的話語(yǔ)權(quán),就必須在離岸金融市場(chǎng)的構(gòu)建中加強(qiáng)我國(guó)的離岸金融法制建設(shè)。 同時(shí),金融危機(jī)啟示我們,法律移植不應(yīng)當(dāng)是盲目照搬的過(guò)程,即便是美國(guó)、馬來(lái)西亞等金融監(jiān)管法制比較完善的國(guó)家,其金融監(jiān)管法制也存在一定的缺陷與漏洞,國(guó)情的特殊性也要求我們?cè)诜梢浦仓斜3指嗟睦硇。同時(shí),我國(guó)的離岸金融監(jiān)管法制的完善也應(yīng)當(dāng)具備一定的前瞻性,從世界大多數(shù)離岸金融中心的發(fā)展來(lái)看,除了我國(guó)目前試點(diǎn)推行的離岸貨幣市場(chǎng),離岸證券市場(chǎng)也應(yīng)當(dāng)是離岸金融市場(chǎng)的重要組成部分,在我國(guó)離岸金融監(jiān)管法制構(gòu)建的過(guò)程中也應(yīng)當(dāng)重視這方面的研究與借鑒。
[Abstract]:Offshore finance, a product of high internationalization and liberalization, has developed into an important part of modern finance in just half a century with its high efficiency and high returns. But offshore finance plays an important role in international financial competition. But offshore finance is a double-edged sword, characterized by its two sides and its finance compared with shore finance. The risk has been significantly enlarged, which has also increased the difficulty of supervision.
The practice of history has proved that the financial reform is always accompanied by the financial crisis. In the financial crisis triggered by the subprime mortgage, the United States, Germany and the United Kingdom have reformed their own financial regulatory legal system. At the same time, it points out that the offshore financial center has played an unnegligible role in the financial crisis.
There are more than twenty years of offshore finance in China. Compared with the United States and Malaysia, the legal construction is obviously backward. There are many defects in the supervision concept, supervision mode, business supervision system, risk regulation system and exit supervision system. It is an important factor that hinders the construction of offshore financial market in China. Therefore, we should take part in the country in an all-round way. In the competition of international finance and the right to speak for the international financial order, we must strengthen our offshore financial legal system in the construction of offshore financial market.
At the same time, the financial crisis enlightens us that legal transplantation should not be a blind copy of the process, even in the United States, Malaysia and other countries with relatively perfect financial regulatory legal system, its financial regulatory legal system also has a certain defect and loopholes, the particularity of the national conditions also requires us to maintain more rational in law transplantation. Meanwhile, the offshore of our country The improvement of the legal system of financial supervision should also be forward-looking. From the development of the most offshore financial centers in the world, the offshore securities market should be an important part of the offshore financial market besides the offshore currency market that is being carried out in our country at present. It should also be heavy in the process of building off shore financial supervision and regulation in China. Look at this aspect of research and reference.
