【摘要】：日本近世朱子學(xué)者蘆東山的著作《無刑錄》以儒家德治主義理念為立法宗旨,主張"圣人之心,天下未嘗有不可化之人"的教育刑論思想。他強(qiáng)調(diào)所有人在道德實(shí)踐上的主體性和平等性,這對(duì)于日本近世的士農(nóng)工商世襲等級(jí)身份制是很大的沖擊和挑戰(zhàn),正是這一思想的先驅(qū)性才使他遭到藩政當(dāng)局的長年迫害。蘆東山借《無刑錄》闡發(fā)的政治主張具有超越時(shí)代與國家的意義。
[Abstract]:The book No Criminal record of Lu Dongshan, a Japanese scholar in modern times, takes the idea of Confucian moral rule as the legislative purpose, and advocates the idea of "sage's heart, there are no immutable people in the world".He emphasized the subjectivity and equality of all people in moral practice, which was a great impact and challenge to the hereditary status system of modern Japanese industry and commerce, and it was the forerunner of this thought that he was persecuted by the vassal authorities for many years.Lu Dongshan's political propositions have the significance of transcending the times and countries.
