【摘要】： 無論是以往的歷朝歷代還是現(xiàn)在,經(jīng)濟(jì)法律制度在國家法制體系中都有著舉足輕重的作用。雖然民國時(shí)期十分短暫,但卻是一個(gè)由舊到新,逐步轉(zhuǎn)變的時(shí)代,尤其是經(jīng)濟(jì)法制的發(fā)展,正處于向近代化急劇轉(zhuǎn)變的過程。民國時(shí)期新疆的經(jīng)濟(jì)法制也處于不斷發(fā)展和完善的時(shí)期,也是新疆地方法制史上承前啟后的時(shí)期。因此,對民國時(shí)期新疆經(jīng)濟(jì)法制建設(shè)的研究具有一定的歷史和現(xiàn)實(shí)意義,這也正是本文研究的主要目的。 本文從三個(gè)方面來進(jìn)行論述。第一部分闡述了民國時(shí)期新疆經(jīng)濟(jì)法制建設(shè)的背景,包括社會概況,經(jīng)濟(jì)發(fā)展概況。第二部分闡述民國時(shí)期新疆經(jīng)濟(jì)法制建設(shè)的主要內(nèi)容,從不同時(shí)期分別考察新疆不同經(jīng)濟(jì)領(lǐng)域的法制建設(shè)情況,經(jīng)濟(jì)法律制度的演變。第三部分對民國時(shí)期新疆經(jīng)濟(jì)法制建設(shè)進(jìn)行評價(jià)。 本文主要利用文獻(xiàn)史料,通過揭示民國時(shí)期新疆經(jīng)濟(jì)法制建設(shè)的發(fā)展演變歷程,深入了解新疆經(jīng)濟(jì)法制產(chǎn)生以及發(fā)展的環(huán)境影響和歷史動因,廓清歷史事實(shí),希望對新疆現(xiàn)階段的經(jīng)濟(jì)法制建設(shè),尤其是經(jīng)濟(jì)立法及實(shí)踐提供借鑒。
[Abstract]:The economic legal system plays an important role in the national legal system, whether in the past dynasties or now.Although the period of the Republic of China was very short, it was a time of gradual change from the old to the new, especially the development of the economic legal system, which was in the process of rapid transformation to modernization.During the period of the Republic of China, the economic legal system of Xinjiang is also in the period of continuous development and perfection, and it is also a period of connecting the past and the future in the history of Xinjiang's local legal system.Therefore, the study of economic legal system construction in Xinjiang during the period of the Republic of China has certain historical and practical significance, which is the main purpose of this paper.This paper discusses from three aspects.The first part expounds the background of the economic legal system construction in Xinjiang during the Republic of China, including the general situation of society and economic development.The second part expounds the main contents of the economic legal system construction in Xinjiang during the period of the Republic of China, and examines the legal construction in different economic fields and the evolution of the economic legal system in Xinjiang from different periods.The third part evaluates the economic legal construction of Xinjiang during the period of the Republic of China.This article mainly uses the literature historical data, through reveals the Xinjiang economic legal system construction development evolution course, deeply understands the Xinjiang economic legal system production, the development environment influence and the historical motive, dissects the historical fact.This paper hopes to provide reference for the construction of economic legal system, especially the economic legislation and practice in Xinjiang.
