【摘要】：法律職業(yè)共同體是指以法官、檢察官、律師、法學(xué)家為核心的法律職業(yè)人員所組成的特殊的社會(huì)群體,它是經(jīng)過(guò)專門法律教育和職業(yè)訓(xùn)練,具有一致法律知識(shí)背景、模式化思維方式、共同法律語(yǔ)言的知識(shí)共同體,具有專業(yè)性、獨(dú)立性、同質(zhì)性、壟斷性等特點(diǎn)。法治現(xiàn)代化就是指法治經(jīng)歷著的從傳統(tǒng)型向現(xiàn)代型的歷史變革過(guò)程。從內(nèi)涵特征來(lái)看,法治現(xiàn)代化是一個(gè)包含了人類法律思想、行為及其實(shí)踐各個(gè)領(lǐng)域的多方面進(jìn)程,其核心是人的現(xiàn)代化。法治現(xiàn)代化的實(shí)現(xiàn)過(guò)程不僅僅是法律制度理性的完善和發(fā)展,還有賴于法律職業(yè)者主體作用的發(fā)揮,換言之,人的積極性、能動(dòng)性、創(chuàng)造性得到發(fā)揮與否,將決定法治的運(yùn)行方向和軌跡。 本文采用比較分析的方法,選定世界范圍內(nèi)各法系內(nèi)頗具代表性的國(guó)家,包括美國(guó)、英國(guó)、德國(guó)、中國(guó)等,研究特定時(shí)期其國(guó)內(nèi)的法官、法學(xué)家、律師群體對(duì)于其法治建設(shè)起到的不同作用,并與我國(guó)法官、法學(xué)家、律師群體起到的作用進(jìn)行比較,并對(duì)中國(guó)法律職業(yè)共同體在法治現(xiàn)代化中起到的作用及其局限性進(jìn)行分析。目前來(lái)看,中國(guó)是一個(gè)正在逐步走向法治現(xiàn)代化的國(guó)家,法律職業(yè)群體在我國(guó)法治現(xiàn)代化的進(jìn)程中起到了很大的積極作用,但由于自身的諸多不足,也表現(xiàn)出了諸多不足,阻礙了法治現(xiàn)代化的進(jìn)程。本文的創(chuàng)新點(diǎn)在于通過(guò)與法治發(fā)達(dá)國(guó)家的法律職業(yè)群體進(jìn)行比較,深入探討中國(guó)法律職業(yè)群體對(duì)于法治發(fā)展存在的不足,以期促進(jìn)中國(guó)法律職業(yè)共同體的建設(shè),推進(jìn)中國(guó)法治現(xiàn)代化建設(shè)的進(jìn)程。
[Abstract]:The legal professional community refers to a special social group composed of judges, prosecutors, lawyers and jurists as the core of the legal profession. It has a consistent legal knowledge background after special legal education and vocational training.Patterns of thinking, common legal language knowledge community, with professional, independent, homogeneity, monopoly and other characteristics.The modernization of the rule of law is the process of historical change from the traditional type to the modern type.From the connotation characteristic, the modernization of rule of law is a multi-aspect process which includes the legal thought, behavior and practice of human beings, the core of which is the modernization of human beings.The realization process of the modernization of the rule of law is not only the perfection and development of the rationality of the legal system, but also depends on the exertion of the main role of the legal profession, in other words, whether the initiative, initiative and creativity of the people are brought into play or not.It will determine the direction and trajectory of the rule of law.This paper, by means of comparative analysis, selects some representative countries in various legal systems of the world, including the United States, Britain, Germany, China, and so on, to study the domestic judges and jurists in a particular period of time.The different roles that lawyers play in the construction of the rule of law are compared with those of judges, jurists and lawyers in China, and the functions and limitations of the legal professional community in China in the modernization of the rule of law are analyzed.At present, China is a country that is gradually moving towards the modernization of the rule of law. The legal profession groups have played a very positive role in the modernization of the rule of law in our country, but because of their many shortcomings, they have also shown a lot of shortcomings.It hinders the modernization of the rule of law.The innovation of this paper lies in comparing with the legal professional groups in developed countries with the rule of law, and deeply discussing the shortcomings of the legal professional groups in China for the development of the rule of law, in order to promote the construction of the legal profession community in China.To promote the modernization of China's rule of law.
