【摘要】：基于共同體理論對協(xié)商民主下的依憲執(zhí)政展開方法論層面的本源式研究,有助于在理念模式上全面解析該問題,從而為既存現(xiàn)實(shí)問題的整全性校正提供可能的方向指引。作為理想類型之協(xié)商民主下的依憲執(zhí)政共同體是一種有效解決協(xié)商民主下依憲執(zhí)政體制機(jī)制中各類具體問題的共同社會(huì)治理生活,其成就與否往往取決于共同體所特有的關(guān)系存續(xù)屬性與系統(tǒng)調(diào)整屬性能否在協(xié)商民主下的依憲執(zhí)政實(shí)踐中彰顯出來。該類共同體應(yīng)具備的互助化關(guān)系存續(xù)屬性主要通過共同體各方成員彼此間的有機(jī)結(jié)合以及共同體與共同體各方成員生成的默認(rèn)一致行動(dòng)而實(shí)現(xiàn),其應(yīng)具備的自足化系統(tǒng)調(diào)整屬性則主要通過共同體中預(yù)設(shè)權(quán)威所推進(jìn)的良性統(tǒng)治而顯現(xiàn)出來。
[Abstract]:Based on the community theory, the original research on the constitutional governance methodology level under deliberative democracy is helpful to the analysis of the problem on the conceptual model, thus providing possible direction for the correction of the integrality of the existing practical problems.As an ideal type of consultative democracy, the constitutional ruling community is an effective solution to various specific problems in the system of constitutional governance under the consultative democracy.Its achievement or not often depends on whether the relationship between the community and the system of adjustment can be manifested in the constitutional governance practice under the deliberative democracy.This kind of community should have the mutualization relation existence attribute mainly through the organic union among the members of the community and the tacit concerted action between the community and the members of the community.The self-contained system adjustment attribute is mainly revealed by the benign rule promoted by the presupposition authority in the community.
