我國法治文明建設(shè)中人文精神的構(gòu)建研究

【摘要】: 如果說法治文明源于對(duì)自身利益和命運(yùn)的一種制度關(guān)懷,那么人文精神必定構(gòu)成它發(fā)生的最原始動(dòng)力。人文精神是貫穿于法治文明的生命線,是法治文明建設(shè)的精神養(yǎng)料。只有充溢著人文精神的法治文明,方能活在人們心中,從而競相趨之。法治文明無論是作為一種治國方略,還是作為一種現(xiàn)實(shí)的法律制度和法律秩序狀態(tài),都包含著人文精神的文化要求。 當(dāng)前,我國法治文明建設(shè)遇到了西方國家不曾遇到的難題——缺乏足以支撐法治的人文精神的基礎(chǔ),人文精神的缺失所造成的人文精神危機(jī)日益顯現(xiàn)。人文精神在過去哺育了西方法治文明,在當(dāng)代也將成為我國法治文明建設(shè)的精神支柱。對(duì)于建構(gòu)當(dāng)代法治文明的人文精神基礎(chǔ)來說,無論是移植西方人文精神的內(nèi)容,還是繼承中國傳統(tǒng)人文精神的精華,都是缺一不可的。因?yàn)槲鞣饺宋木衲軌虼呱霈F(xiàn)代西方法治,必定存在著可供我們借鑒的優(yōu)秀成分;而中國傳統(tǒng)人文精神作為中華民族積極進(jìn)取的精神動(dòng)力,與當(dāng)代我國法治文明必然存在著內(nèi)在的邏輯聯(lián)系。 人文精神以關(guān)懷人為宗旨,遺憾的是,學(xué)界對(duì)這個(gè)話題談的很多,卻在法治文明建設(shè)中如何構(gòu)建人文精神的研究很少。本文首先對(duì)這個(gè)問題的理論內(nèi)涵和實(shí)質(zhì)做一番先行的、深入的考察,說明法治文明與人文精神存在著天然的淵源,對(duì)法治文明與人文精神的內(nèi)涵予以厘清,通過分析,得出法治文明的平等、自由、人權(quán)和正義價(jià)值體現(xiàn)著人文精神,具有人文性。其次,本文考察了中西方法治思想中的人文精神,人文精神在中國傳統(tǒng)法治思想中是缺失的,而在西方法治思想中卻閃爍著其璀璨的光芒。再次,本文分析了我國法治文明建設(shè)中的人文精神危機(jī),這些危機(jī)概括為:我國法治文明建設(shè)缺乏對(duì)公權(quán)力的制約,導(dǎo)致對(duì)人的權(quán)利的漠視;我國法治文明建設(shè)在重心選擇上的失誤,使公平、正義等價(jià)值理念在人文精神中難覓其蹤;我國法治文明建設(shè)重形式,輕實(shí)質(zhì),缺乏人的主體性參與。分析的結(jié)果引發(fā)我們的思考,導(dǎo)致這種危機(jī)的原因是我國在法治文明建設(shè)中忽視了對(duì)人文精神的建構(gòu)。由此,文章的第五部分提出了在我國法治文明建設(shè)中的原則、內(nèi)容和途徑。
[Abstract]:If the civilization of rule of law originates from an institutional concern for its own interests and destinies, then the humanistic spirit must constitute the most primitive motive force of its occurrence.Humanistic spirit is the lifeline running through the civilization of rule of law and the spiritual nourishment of the construction of civilization of rule of law.Only the civilization of rule of law, which is full of humanistic spirit, can live in people's hearts and compete with each other.The civilization of the rule of law, whether as a strategy of governing the country, or as a realistic legal system and legal order, contains the cultural requirements of the humanistic spirit.At present, the construction of the civilization of rule of law in our country has encountered the difficult problem that the western countries have never encountered-the lack of the foundation of the humanistic spirit enough to support the rule of law, and the crisis of the humanistic spirit caused by the lack of the humanistic spirit is emerging day by day.Humanistic spirit has nurtured the western civilization of rule of law in the past, and will also become the spiritual pillar of the construction of civilization of rule of law in our country.For constructing the humanistic spirit foundation of the contemporary civilization of rule of law, it is indispensable to transplant the contents of the western humanistic spirit or inherit the essence of the Chinese traditional humanistic spirit.Because the western humanistic spirit can give birth to the modern western rule of law, there must be excellent elements for us to learn from it; and the Chinese traditional humanistic spirit serves as the spiritual motive force for the Chinese nation to be active and enterprising.There must be an inherent logical connection with the civilization of the rule of law in contemporary China.The aim of humanistic spirit is to care for people. Unfortunately, scholars talk a lot about this topic, but there is little research on how to construct humanistic spirit in the construction of civilization of rule of law.In this paper, the theoretical connotation and essence of this problem are first investigated, which shows that there are natural origins between the civilization of rule by law and the spirit of humanism, and clarifies the connotation of the civilization of rule of law and the spirit of humanism.The value of equality, freedom, human rights and justice embodies humanism and humanism.Secondly, this paper examines the humanistic spirit in the Chinese and western thoughts of ruling by law, which is absent in the Chinese traditional thought of ruling by law, but glitters with its bright light in the thought of western rule of law.Thirdly, this paper analyzes the humanistic spiritual crisis in the construction of civilization of rule of law in China. These crises are summarized as follows: the lack of restriction on public power in the construction of civilization of rule of law leads to the disregard of human rights;The mistakes in the choice of the center of gravity in the construction of the civilization of rule of law make it difficult to trace the value concepts such as fairness and justice in the humanistic spirit, and the construction of the civilization of rule of law in our country emphasizes the form, neglects the essence, and lacks the subjective participation of human beings.The result of the analysis leads us to think, and the reason for this crisis is that our country neglects the construction of humanistic spirit in the construction of civilization of rule of law.Therefore, the fifth part of the article puts forward the principles, contents and approaches in the construction of the civilization of rule of law in our country.
