【摘要】：邊境既指國(guó)家邊界線兩側(cè)一定寬度的區(qū)域,也稱之為邊境地區(qū)。邊境地區(qū)環(huán)境問(wèn)題不僅具有一般環(huán)境問(wèn)題的屬性,更具有跨越國(guó)家邊界等的特殊性,因而在解決邊境地區(qū)環(huán)境爭(zhēng)端時(shí)必須明確爭(zhēng)端產(chǎn)生的原因及其復(fù)雜性和特殊性,其解決的方法不僅需有針對(duì)性更需有實(shí)效性。同時(shí),邊境地區(qū)環(huán)境資源的保護(hù)和開(kāi)發(fā)利用不僅需要考慮邊境地區(qū)實(shí)際情況,更需要遵循相應(yīng)的法律原則,建立健全適合邊境地區(qū)的法律機(jī)制,使邊境地區(qū)環(huán)境保護(hù)和開(kāi)發(fā)利用有法可依,不僅安民戍邊,更促進(jìn)了邊境地區(qū)經(jīng)濟(jì)社會(huì)的和諧發(fā)展,并增強(qiáng)國(guó)家間的友好交流與合作。
[Abstract]:Border refers to both sides of the national border area of a certain width, also known as the border area.The environmental problems in border areas not only have the attributes of general environmental problems, but also have the particularity of crossing national boundaries, etc. Therefore, in solving environmental disputes in border areas, it is necessary to make clear the causes, complexity and particularity of disputes.The solution not only needs pertinence but also effectiveness.At the same time, the protection, development and utilization of environmental resources in border areas need not only to consider the actual situation in border areas, but also to follow the corresponding legal principles and to establish and improve legal mechanisms suitable for border areas.In order to protect the environment and develop and utilize the border area according to the law, not only the people can defend the border, but also the harmonious development of economy and society in the border area will be promoted, and the friendly exchange and cooperation among countries will be strengthened.
