【摘要】：民主政制是一種具有多種終局可能和理論缺陷的政體。在政治實(shí)踐上,它有蛻化為僭主專政和民粹主義的潛在基因,這在納粹主義和雅各賓專政中得到鮮明的例示。從理論前提上看,美國式民主是一種強(qiáng)調(diào)形式正義的混合民主政體,但民主選舉程序的合法并不意味結(jié)果的公正。合法(形式正義)與正義(實(shí)質(zhì)正義)之間的巨大裂痕,為賢明君主制(仁慈僭政)統(tǒng)治的正當(dāng)性提供了理論上的可能,同時(shí)也讓我們警惕民主政制潛含的政治風(fēng)險(xiǎn)。由是觀之,民主憲政并非主流觀念所宣揚(yáng)的那么理想完美和理所應(yīng)當(dāng)。廓清民主憲政的實(shí)踐變體和德性缺失,不僅有助于我們審慎理性地看待世紀(jì)之交的這場(chǎng)憲政之爭(zhēng),同時(shí)也對(duì)我們更好地進(jìn)行政治文明建設(shè)提供了重要的理論參考。
[Abstract]:Democracy is a form of government with many possibilities and theoretical flaws.In political practice, it has the potential to degenerate into autocratic dictatorship and populism, which is clearly illustrated by Nazism and Jacobin dictatorship.On the theoretical premise, American democracy is a mixed democracy that emphasizes formal justice, but the legitimacy of democratic election procedure does not mean the justice of the result.The huge rift between legitimacy (formal justice) and justice (substantive justice) provides a theoretical possibility for the legitimacy of the rule of the wise monarchy (merciful tyrant), and at the same time makes us alert to the political risks of democracy.Thus, democratic constitutionalism is not so ideal and well-deserved as the mainstream idea.To clarify the practical variation and lack of virtue of democratic constitutionalism is not only helpful for us to treat this constitutional dispute at the turn of the century prudently and rationally, but also provides an important theoretical reference for us to better carry out the construction of political civilization.
