【摘要】：高成本制度體系不利于地方政府在新一輪競爭格局中勝出,傳統(tǒng)壓力型發(fā)展模式和激勵(lì)機(jī)制已出現(xiàn)明顯"負(fù)效應(yīng)"。要讓地方在推行法治、提供善治、提高社會治理水平和公共服務(wù)質(zhì)量等方面充分發(fā)揮作用,必須尊重和有益于地方可持續(xù)發(fā)展、促進(jìn)制度正向激勵(lì),并大力創(chuàng)新具備實(shí)踐解釋力的地方競爭范式和分析框架。只有逐步將壓力型治理結(jié)構(gòu)轉(zhuǎn)變?yōu)橐?guī)則型治理結(jié)構(gòu),形成統(tǒng)一的司法權(quán)治理體制與運(yùn)行機(jī)制,"條條塊塊"權(quán)力制約規(guī)范有力,地方發(fā)展模式尤其是競爭模式才能逐步實(shí)現(xiàn)良性運(yùn)轉(zhuǎn)。作為地方,被動或者主動的制度調(diào)適將成為本輪改革的"競優(yōu)"選擇,法治需求將在"誘致型"和"倒逼型"社會變遷進(jìn)程中更加凸顯。
[Abstract]:The system of high cost system is not conducive to the local government winning in the new round of competition, and the traditional pressure-type development model and incentive mechanism have already appeared obvious "negative effect".For local authorities to play their full role in promoting the rule of law, providing good governance, improving the level of social governance and the quality of public services, it is essential to respect and benefit local sustainable development and to promote positive institutional incentives,And innovates vigorously the local competition paradigm and the analysis frame which has the practice explanation power.Only by gradually transforming the pressure-type governance structure into the rule-based governance structure, forming a unified judicial power governance system and operating mechanism, "strip block" power restriction has the force,The local development model, especially the competition model, can gradually realize the benign operation.
