【摘要】：鄧小平法制思想產(chǎn)生于中國特定的歷史背景下,對當(dāng)時中國社會的發(fā)展起了巨大的促進和保障作用,產(chǎn)生了深刻的國內(nèi)、國際影響。時至今日,鄧小平法制思想中蘊含的一些經(jīng)典理論,對當(dāng)前的中國社會有巨大的指導(dǎo)和借鑒意義以及現(xiàn)實價值。鄧小平法制思想屬于廣義的馬克思主義法學(xué)范疇,是馬克思主義法學(xué)中國化的產(chǎn)物,是以鄧小平的法制思想為核心的中國共產(chǎn)黨集體法制思想的結(jié)晶,也是鄧小平理論的重要組成部分。鄧小平法制思想在中國特殊的國內(nèi)、國際背景下產(chǎn)生,具有承上啟下的意義。 鄧小平法制思想吸收了國內(nèi)外社會主義建設(shè)的經(jīng)驗教訓(xùn),形成于二戰(zhàn)以后世界范圍內(nèi)恢復(fù)法制建設(shè)的背景下,除此之外,我們還要特別關(guān)注其個人經(jīng)歷對鄧小平法制思想產(chǎn)生的影響。鄧小平法制思想是在借鑒馬克思列寧主義法學(xué)理論,以毛澤東為主的中國共產(chǎn)黨第一代領(lǐng)導(dǎo)集體的法律思想,中國傳統(tǒng)法律文化中的法制觀點等理論的基礎(chǔ)上而逐漸成熟,自成一體。從而形成了與時代緊密結(jié)合的法制思想特色,主要包括堅持民主和法制的辯證統(tǒng)一關(guān)系,堅持黨與法制的相互制約關(guān)系,堅持始終以經(jīng)濟建設(shè)為中心的法制建設(shè)原則,其核心內(nèi)容是法治。鄧小平法制思想涵蓋內(nèi)容多,涉及面很廣,主要包括思想上高度重視法制的作用,實踐中不斷完善法制,重視普法教育和干部法制素養(yǎng)的提高,“一國兩制”理論。在把握了鄧小平法制思想的內(nèi)容后,更重要的是研究鄧小平法制思想的當(dāng)代價值,鄧小平法制思想為我國依法治國思想提供了理論支持,促進社會主義市場經(jīng)濟和社會主義民主政治的發(fā)展,推動深化政治體制改革,催生法學(xué)專業(yè)教育,發(fā)展壯大法律職業(yè)隊伍。
[Abstract]:Deng Xiaoping's legal thought Chinese produced in specific historical background, the development of Chinese society has played a great role in the promotion and protection, profound domestic and international influence. Today, some of the classic Deng Xiaoping theory contains legal thoughts, has great guidance and reference significance and practical value to the current social Chinese Deng Xiaoping Marx School of law in legal thought belongs to the broad scope of the law, is a product of Marx Chinese the thoughts Chinese Communist Party collective legal system in Deng Xiaoping's legal thought as the core, is also an important part of Deng Xiaoping theory. Deng Xiaoping thought of legal system in China special domestic, international background, has important significance.
Deng Xiaoping's legal thought absorbed the lessons of socialist construction at home and abroad, formed after the Second World War in the world to restore the rule of law construction in the background, in addition, we must pay special attention to the personal experience of Deng Xiaoping's legal thought. The influence of Deng Xiaoping's legal thought is in reference to the theory of Marx Lenin School of law, China of the first generation of collective leadership the legal thoughts on Mao Zedong, China foundation in the traditional legal culture legal opinions on the theory of gradually mature, self-contained. Thus combined with the era of legal thought characteristic, mainly including the dialectical relationship between upholding democracy and legal system, adhere to the mutual relationship between the party and the legal system, always insist on the economic construction as the center of legal construction principle, which is the core of the rule of law. Deng Xiaoping's legal thought content, involves a Wide, including ideologically attached great importance to the role of legal system, legal system and constantly improve the practice, pay attention to legal education and cadres legal literacy, "one country two systems" theory.
