【摘要】：本文以在九屆人大二次會議上被確定為憲法原則的“依法治國、建設(shè)社會主義法治國家”治國方略為出發(fā)點,結(jié)合當(dāng)代大學(xué)生是建設(shè)中國特色社會主義事業(yè)的建設(shè)者和接班人的實際,論述了對當(dāng)代大學(xué)生進(jìn)行社會主義法治教育,提升包含法律基本知識、法治觀念和法治意識在內(nèi)的法律素質(zhì)對我國建設(shè)社會主義法治國家、完善社會主義市場經(jīng)濟(jì)、加強(qiáng)兩個文明建設(shè)、促進(jìn)大學(xué)生全面發(fā)展的重大意義。本文從剖析基本的法學(xué)概念“法治”入手,在綜合分析國內(nèi)外不同學(xué)者論述“法治”這個概念的基礎(chǔ)上,提出了對當(dāng)代大學(xué)生進(jìn)行社會主義法治教育的必要性和重要性,深刻分析了當(dāng)代大學(xué)生社會主義法治教育在新形勢下所面臨的問題和原因,詳細(xì)闡述了當(dāng)代大學(xué)生社會主義法治教育的內(nèi)容及其實現(xiàn)措施和途徑。 本文由四個部分組成:文章的第一部分重點解釋了在古今中外法學(xué)理論界爭論較大的“法治”涵義的問題。作者在國內(nèi)外不同時代、具有代表性的學(xué)者亞里士多德、埃爾伯特·維納·戴雪、孟德斯鳩、韓非子、梁啟超、孫中山及中國當(dāng)代學(xué)者對“法治”論斷的基礎(chǔ)上,通過鑒別、分析、比較,從建設(shè)中國特色社會主義的角度分析了當(dāng)代“法治”的涵義,形成了筆者對“法治”涵義的概括。在此基礎(chǔ)上,延伸出了“法治教育”和“大學(xué)生社會主義法治教育”的基本概念,并以“依法治國、建設(shè)社會主義法治國家”治國方略和建設(shè)中國特色社會主義為出發(fā)點著重論述了加強(qiáng)當(dāng)代大學(xué)生社會主義法治教育的重要意義。文章的第二部分在綜合不同學(xué)者對加強(qiáng)社會主義法治教育觀點的基礎(chǔ)上,深刻分析了加強(qiáng)當(dāng)代大學(xué)生社會主義法治教育所面臨的形勢和亟需解決的問題,并對產(chǎn)生這些問題的原因作了深刻闡述。文章的第三部分以當(dāng)代大學(xué)生的全面發(fā)展為基礎(chǔ),以培養(yǎng)當(dāng)代大學(xué)生所必須的法律素質(zhì)為目的,提出了加強(qiáng)當(dāng)代大學(xué)生社會主義法治教育的主要內(nèi)容應(yīng)該是對當(dāng)代大學(xué)生進(jìn)行以包含憲法意識、社會主義法治理念及基本法律制度在內(nèi)的教育。文章的第四部分在作者大量閱讀關(guān)于當(dāng)代大學(xué)生社會主義法治教育文獻(xiàn)的基礎(chǔ)上,深刻分析了我國高校對當(dāng)代大學(xué)生進(jìn)行社會主義法治教育的具體措施和途徑,提出了對當(dāng)代大學(xué)生進(jìn)行社會主義法治教育的新方法、新設(shè)想。

This paper consists of four parts: the first part mainly explains in the law theory circles at all times and in all countries of "rule of law" the meaning of the problem. Different authors at home and abroad, the representative scholar Aristotle, Elbert, Weiner Dako, Montesquieu, Liang Qichao, Sun Zhongshan and Han Fei, based China contemporary scholars on the "rule of law" argument on through the identification, analysis, comparison, from the point of view of the characteristics of socialist construction Chinese contemporary "rule of law" meaning, the author summarizes the meaning of the "rule of law". On this basis, extend the basic concept of "rule of law education" and "college socialist legal education", and to "the rule of law the construction of socialism, socialist country under the rule of law governing policy and construction of China characteristics as the starting point focuses on strengthening the College Students Society The important meaning of law education. The second part of the article in the different scholars on the basis of strengthening the socialist legal education ideas, profound analysis of the strengthening of socialist rule of law education of contemporary college students facing the situation and problems to be solved, and the reasons for these problems were expounded. The third part is on the basis of comprehensive development of contemporary college students, to cultivate the legal quality of contemporary college students must be put forward for the purpose of strengthening the main content of the socialist rule of law education of contemporary university students should be on the contemporary college students to contain the constitution consciousness, the socialist concept of rule of law and legal system, basic education. The fourth part of the article based on a lot of reading in the literature of socialist rule of law the education of contemporary college students, analyzes the universities of our country society of Contemporary College Students The concrete measures and ways of the rule of law education of the rule of law have put forward a new method and new idea for the socialist rule of law education for contemporary college students.
