【摘要】：宗教法治不僅是全民參與、全社會(huì)"互動(dòng)"的過程,而且政府在"互動(dòng)"中應(yīng)發(fā)揮協(xié)調(diào)溝通作用,實(shí)現(xiàn)由人治、權(quán)治,向法治、從管理到服務(wù)、由"制約"向"引導(dǎo)"方面的轉(zhuǎn)化。宗教法治需要對(duì)宗教界人士和全體公民開展法治教育,宗教法律在自覺、自律的基礎(chǔ)上得到普遍遵守是宗教法治的基本要求和重要標(biāo)志。"法律是治國(guó)之重器,良法是善治之前提",通過宗教立法、執(zhí)法、司法和守法的動(dòng)態(tài)管理模式,實(shí)現(xiàn)宗教法治管理他律與自律的統(tǒng)一。正確認(rèn)識(shí)和區(qū)分宗教信仰和宗教行為,以及宗教違法行為的刑事處罰性。尊重習(xí)慣與規(guī)范行為,處理好風(fēng)俗習(xí)慣與宗教信仰行為之間的關(guān)系,制定信教群眾、宗教工作者、宗教活動(dòng)及其場(chǎng)所的行為規(guī)范等,是宗教法治理念、模式與路徑的必然選擇。
[Abstract]:The religious rule of law is not only the process of the participation of the whole people and the "interaction" of the whole society, but also the role of the government in coordinating and communicating in the "interaction" so as to realize the rule of law by the people, the rule of power, the rule of law, from management to service. The transformation from "restriction" to "guidance". The religious rule of law requires education on the rule of law for religious circles and all citizens, and religious laws are self-conscious, On the basis of self-discipline, universal compliance is the basic requirement and important symbol of religious rule of law. "Law is the important instrument of governing the country, and good law is the premise of good governance." the dynamic management model of religious legislation, law enforcement, justice and law-abiding is adopted. To realize the unification of heteronomy and self-discipline in the administration of religious rule by law, to correctly understand and distinguish between religious beliefs and religious acts, and to establish criminal penalties for religious violations, and to respect custom and normative conduct, It is the inevitable choice of religious rule of law, mode and path to handle the relationship between custom and religious belief, and to formulate the behavior norms of religious masses, religious workers, religious activities and their places.
