【摘要】：我國(guó)社會(huì)主義經(jīng)濟(jì)的特征之一就是實(shí)施法制建設(shè),而我國(guó)職業(yè)籃球在實(shí)行市場(chǎng)化時(shí)也應(yīng)該順應(yīng)這一發(fā)展趨勢(shì),要加快職業(yè)籃球發(fā)展的步伐,把法制體制運(yùn)用到職業(yè)籃球的管理中。職業(yè)籃球在市場(chǎng)運(yùn)作過(guò)程中會(huì)必然面臨著大量的經(jīng)濟(jì)行為和法律問(wèn)題。比如,在改革過(guò)程中由于利益主體的多元性和籃球從業(yè)人員法律意識(shí)的匱乏,導(dǎo)致了許多矛盾與法律問(wèn)題的出現(xiàn),有些個(gè)別事件直接損害了相關(guān)當(dāng)事人的利益。因此,建立職業(yè)籃球法律法規(guī)體系是推進(jìn)我國(guó)職業(yè)籃球改革健康快速發(fā)展的有力保證。目前我國(guó)學(xué)者對(duì)職業(yè)籃球法制研究多是呈現(xiàn)分散性的狀況,本文以一般社會(huì)學(xué)和相應(yīng)的法律法規(guī)體系的研究為基礎(chǔ),綜合運(yùn)用了法學(xué)理論及各種具體的法律知識(shí),結(jié)合我國(guó)籃球職業(yè)化的具體實(shí)踐,對(duì)我國(guó)職業(yè)籃球的法制環(huán)境發(fā)展現(xiàn)狀,國(guó)外職業(yè)籃球法制發(fā)展概況和我國(guó)職業(yè)籃球存在的問(wèn)題等進(jìn)行較為全面和細(xì)致的論述,從宏觀的角度對(duì)我國(guó)職業(yè)籃球的法制環(huán)境建設(shè)進(jìn)行探討,并提出了具體的措施和發(fā)展對(duì)策。主要結(jié)論: 本研究課題通過(guò)進(jìn)一步的理論分析得出:我國(guó)職業(yè)籃球在我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)條件下要健康發(fā)展,首先要建立健全完善的職業(yè)籃球法規(guī)體系,使我國(guó)職業(yè)籃球俱樂(lè)部的經(jīng)營(yíng)者處在法制化和系統(tǒng)化的法制管理系統(tǒng)之中。通過(guò)分析得知,當(dāng)前我國(guó)體育管理機(jī)制不能完全適應(yīng)我國(guó)社會(huì)主義市場(chǎng)經(jīng)濟(jì)的發(fā)展,與我國(guó)職業(yè)籃球的發(fā)展也存在著一定的制約性,需要對(duì)其在體制上進(jìn)行一些相應(yīng)的調(diào)整。有必要在我國(guó)建立職業(yè)籃球俱樂(lè)部聯(lián)盟性質(zhì)的組織,實(shí)行市場(chǎng)化和企業(yè)化的運(yùn)作方式,使其具有獨(dú)立的法人地位,經(jīng)營(yíng)活動(dòng)自主進(jìn)行,接受法律領(lǐng)域相關(guān)法規(guī)的管理和上級(jí)體育行政部門的行政領(lǐng)導(dǎo)。目前我國(guó)已經(jīng)具備了構(gòu)建職業(yè)籃球法規(guī)體系的條件。隨著我國(guó)職業(yè)籃球的實(shí)踐,體育立法機(jī)構(gòu)應(yīng)逐步制定和完善職業(yè)籃球的管理法規(guī),主要在法律意識(shí)、法律規(guī)范、法律組織、法律行為和法律監(jiān)督這五方面進(jìn)行完善。我國(guó)職業(yè)籃球的管理法規(guī)還存在著不足的一面,需要出臺(tái)的法規(guī)主要包括關(guān)于人才流動(dòng)管理方面的規(guī)定,職業(yè)籃球運(yùn)動(dòng)員人身保險(xiǎn)與肖像權(quán)等方面的法規(guī)制度。
[Abstract]:One of the characteristics of China's socialist economy is the implementation of the legal system, and China's professional basketball in the implementation of the market should conform to this development trend, to speed up the pace of professional basketball development, Apply the legal system to the management of professional basketball. Professional basketball will inevitably face a large number of economic behavior and legal problems in the course of market operation. For example, In the process of reform, because of the diversity of the main body of interest and the lack of legal consciousness of basketball practitioners, many contradictions and legal problems appear, and some individual events directly damage the interests of the relevant parties. The establishment of professional basketball laws and regulations system is a powerful guarantee to promote the healthy and rapid development of professional basketball reform in China. Based on the research of the general sociology and the corresponding laws and regulations system, this paper makes comprehensive use of the law theory and various kinds of specific legal knowledge, and combines the concrete practice of basketball professionalization in our country, to the present situation of the legal environment development of the professional basketball of our country. The general situation of the development of professional basketball legal system in foreign countries and the problems existing in professional basketball of our country are discussed in detail, and the legal environment construction of professional basketball in China is discussed from the macroscopic angle. The main conclusions are as follows:. This research subject through further theoretical analysis: China's professional basketball in the socialist market economy in order to develop healthily, first of all, we must establish a sound and perfect professional basketball laws and regulations system. Make the operators of professional basketball clubs in our country in the legal and systematic legal management system. Through the analysis, we know that the current sports management mechanism of our country can not fully adapt to the development of the socialist market economy of our country. There are some restrictions on the development of professional basketball in China, which need to be adjusted in the system. It is necessary to set up the organization of professional basketball club in our country, and implement the operation mode of marketization and enterprise. To enable them to have the status of independent legal persons and to carry out their business activities independently, Accept the management of the relevant laws and regulations in the legal field and the administrative leadership of the sports administrative department at the higher level. At present, our country already has the condition to construct the professional basketball regulation system. With the practice of the professional basketball in our country, The sports legislative body should gradually formulate and perfect the management laws and regulations of professional basketball, mainly in the legal consciousness, the legal norm, the legal organization, The five aspects of legal conduct and legal supervision are improved. There are still some deficiencies in the regulations governing professional basketball in our country. The laws and regulations that need to be introduced mainly include regulations on the management of the flow of talents. Professional basketball players personal insurance and portrait rights and other aspects of the legal system.
