【摘要】：產(chǎn)業(yè)政策是當(dāng)前我國各級政府干預(yù)經(jīng)濟(jì)的一種重要方式,圍繞其利弊,2016年下半年以來,經(jīng)濟(jì)學(xué)界掀起了一場大論戰(zhàn),至今未息。在現(xiàn)代法治社會,經(jīng)濟(jì)問題在一定程度上也是法律問題。產(chǎn)業(yè)政策是政府對經(jīng)濟(jì)活動的干預(yù),在一個法治社會里,如何保證產(chǎn)業(yè)政策與法治要求相容就成為一個重要命題。在法治社會和市場經(jīng)濟(jì)條件下,政府對經(jīng)濟(jì)的任何干預(yù)均應(yīng)在法治的框架下運(yùn)行,政府以產(chǎn)業(yè)政策干預(yù)經(jīng)濟(jì),不僅要考慮經(jīng)濟(jì)目的和政府意志,更要具備基本的法治意識。結(jié)合我國的具體國情,這些基本的法治意識主要有"有限政府"的意識、"權(quán)利平等"的意識、"透明決策"的意識和"責(zé)任政府"的意識,這些基本的法治意識是促使政府產(chǎn)業(yè)政策與法治要求相容的深層保障。
[Abstract]:Industrial policy is an important way for governments at all levels to intervene in the economy at present. Focusing on its advantages and disadvantages, since the second half of 2016, there has been a great debate in the economic circles, which has not ceased to date. In the modern society ruled by law, To a certain extent, economic problems are also legal problems. Industrial policy is the government's intervention in economic activities. In a society ruled by law, How to ensure the compatibility of industrial policy with the requirements of the rule of law is an important proposition. Under the conditions of a society ruled by law and a market economy, any government intervention in the economy should operate within the framework of the rule of law, and the government should intervene in the economy by industrial policy. We should not only consider economic objectives and the will of the government, but also have a basic sense of the rule of law. These basic consciousness of rule of law mainly include the consciousness of "limited government", "equality of rights", "transparent decision-making" and "responsible government". These basic consciousness of rule of law are the deep guarantee to make government industrial policy compatible with the requirement of rule of law.
