【摘要】： 過去我們的研究主要限于將規(guī)劃視為土地控制工具的技術(shù)性層面,使得規(guī)劃理論的專業(yè)性嬗變?yōu)橐?guī)劃實(shí)踐的封閉性,難以回應(yīng)時(shí)代發(fā)展對(duì)規(guī)劃的挑戰(zhàn)。 為了更加明確我們的未來,為了增加我們土地利用的選擇性和提高我們規(guī)劃的民主性和科學(xué)性,作為一種體現(xiàn)公共政策屬性的制度安排,土地利用規(guī)劃走向成熟的下一個(gè)領(lǐng)域,是找到裁決和平衡各種相互競(jìng)爭(zhēng)利益的方法,建立一種更為協(xié)調(diào)的社區(qū)。因此,本研究擬將自然科學(xué)和社會(huì)科學(xué)的發(fā)現(xiàn)結(jié)合起來,在國(guó)內(nèi)外已有研究成果的基礎(chǔ)上,以解決我國(guó)土地利用規(guī)劃制度中問題與挑戰(zhàn)為意旨,闡明在全球化、法治化背景下的土地利用規(guī)劃創(chuàng)新思維,一改過去僅單純技術(shù)性的研究轉(zhuǎn)而運(yùn)用法學(xué)的理論從本質(zhì)內(nèi)涵、規(guī)劃主體、權(quán)力配置、生成模式、救濟(jì)機(jī)制等層面重新思考這一具有政治色彩的制度理性,選擇規(guī)劃變革的應(yīng)對(duì)策略,并構(gòu)建我國(guó)轉(zhuǎn)型期土地利用規(guī)劃分析的基本理論框架,回應(yīng)規(guī)劃從功能理性向制度理性的變革的理論需求,從而更好地影響土地利用規(guī)劃的發(fā)展方向和本質(zhì)、更好地使得不同范疇的規(guī)劃層級(jí)結(jié)合起來、更多地考慮公眾價(jià)值和公眾需要來完善規(guī)劃過程,為系統(tǒng)研究土地規(guī)劃理論提供了一個(gè)全新的視角,甚或?yàn)楫?dāng)下的規(guī)劃實(shí)踐提供一個(gè)學(xué)理上的參考資料。 為此本研究的基本思路是：通過從法學(xué)角度對(duì)土地利用規(guī)劃的本質(zhì)、屬性和運(yùn)行邏輯的制度性分析,在全球化的視野里歸納土地利用規(guī)劃?rùn)C(jī)制中的共同問題,考察不同國(guó)家對(duì)問題的可能性回應(yīng)及其未來的走向,結(jié)合對(duì)我國(guó)土地利用規(guī)劃的現(xiàn)狀及具體問題的分析,在治理理論、博弈理論、協(xié)商民主理論的指導(dǎo)下,做出變革我國(guó)土地利用規(guī)劃的未來選擇,使土地利用規(guī)劃成為一個(gè)民主實(shí)踐的過程,一個(gè)真正的考慮全面的研究過程。
[Abstract]:In the past, our research was mainly limited to the planning as a technical level of land control tools, making the professional evolution of planning theory into the closeness of planning practice, so it is difficult to respond to the challenges of the development of the times to the planning. In order to make our future clearer, to increase the selectivity of our land use and to make our planning more democratic and scientific, as an institutional arrangement that reflects the attributes of public policy, The next area where land-use planning matures is finding ways to adjudicate and balance competing interests and to build a more coordinated community. Based on the existing research results at home and abroad, this paper aims at solving the problems and challenges in China's land use planning system, and expounds the innovative thinking of land use planning under the background of globalization and legalization. One is to rethink this political system rationality from the aspects of essence connotation, planning subject, power allocation, generating mode, relief mechanism and so on, instead of purely technical research in the past and using the theory of law. Choosing the corresponding strategy of planning reform, and constructing the basic theoretical framework of land use planning analysis in the transition period of our country, and responding to the theoretical demand of the transformation from functional rationality to institutional rationality. In order to better affect the development direction and nature of land use planning, better make different planning levels combined, more consideration of public value and public needs to improve the planning process, It provides a new perspective for the systematic study of land planning theory, or even a theoretical reference for the present planning practice. The basic idea of this study is: through the institutional analysis of the essence, attributes and operational logic of land use planning from the perspective of law, we can conclude the common problems in the mechanism of land use planning from the perspective of globalization. Considering the possible responses of different countries to the problems and their future trends, combining with the analysis of the present situation and specific problems of land use planning in China, under the guidance of governance theory, game theory and the theory of deliberative democracy, In order to make the future choice of land use planning reform in China, land use planning becomes a process of democratic practice and a real and comprehensive research process.
