【摘要】：在貴州,面對高消耗、高能耗、高污染的粗放型發(fā)展模式帶來的經(jīng)濟(jì)約束以及不堪重負(fù)的生態(tài)環(huán)境,發(fā)展循環(huán)經(jīng)濟(jì)成為必然的選擇。大力發(fā)展貴州循環(huán)經(jīng)濟(jì)是落實科學(xué)發(fā)展觀的具體實踐,是建設(shè)資源節(jié)約型社會的客觀要求,是建設(shè)環(huán)境友好型社會的重要載體和途徑,也是當(dāng)今世界經(jīng)濟(jì)發(fā)展和環(huán)境保護(hù)的潮流。發(fā)達(dá)國家已經(jīng)建立了比較完善的循環(huán)經(jīng)濟(jì)法律保障體系并收到了良好的社會效果,而貴州目前的循環(huán)經(jīng)濟(jì)法治建設(shè)卻還存在諸多不足,根本滿足不了循環(huán)經(jīng)濟(jì)發(fā)展的要求,非常有必要構(gòu)建一個科學(xué)、全面的循環(huán)經(jīng)濟(jì)法律支撐體系并確立合理的基本法律制度,這是循環(huán)經(jīng)濟(jì)的基本保障。 在貴州這樣一個相對比較落后的地區(qū)發(fā)展循環(huán)經(jīng)濟(jì)法治還具有重要的標(biāo)本價值。就貴州省地方立法與國家專門立法的關(guān)系而言,加強(qiáng)對地方立法的研究不僅可以為全國性立法提供理論和實踐支撐,還可以在國家立法的大背景下,進(jìn)一步深化貴州省地方循環(huán)經(jīng)濟(jì)立法,以法律規(guī)范政府的相關(guān)措施,引導(dǎo)企業(yè)行為;通過科學(xué)規(guī)劃、反復(fù)實踐、制度規(guī)范、全民參與等多種途徑,有效推進(jìn)貴州省經(jīng)濟(jì)社會和環(huán)境全面、協(xié)調(diào)、可持續(xù)發(fā)展,實現(xiàn)人與自然的和諧發(fā)展,為構(gòu)建“和諧貴州”提供良好的法治環(huán)境。從此意義而言,本文不僅具有深遠(yuǎn)的理論價值而且具有強(qiáng)烈的現(xiàn)實意義。
[Abstract]:In Guizhou, the extensive development model of high consumption, high energy consumption and high pollution brings economic constraints and overburdened ecological environment. Developing circular economy is an inevitable choice. Vigorously developing Guizhou circular economy is the concrete practice of carrying out the scientific development view, the objective requirement of building a resource-saving society, and the important carrier and way of constructing an environment-friendly society. It is also the trend of economic development and environmental protection in the world today. Developed countries have established a relatively perfect legal protection system for circular economy and have received good social effects. However, the current construction of circular economy in Guizhou still has many shortcomings, which can not meet the requirements of circular economy development. It is very necessary to build a scientific and comprehensive legal support system of circular economy and to establish a reasonable basic legal system. This is the basic guarantee of circular economy. The development of circular economy and the rule of law in a relatively backward region such as Guizhou also has important specimen value. As far as the relationship between Guizhou local legislation and national special legislation is concerned, Strengthening the research on local legislation can not only provide theoretical and practical support for national legislation, but also further deepen the local circular economy legislation in Guizhou Province under the background of national legislation, and standardize the relevant measures of the government by law. To guide enterprise behavior; to effectively promote the comprehensive, coordinated and sustainable development of Guizhou's economy, society and environment through scientific planning, repeated practice, institutional norms, and popular participation, and to realize the harmonious development of man and nature. It provides a good legal environment for the construction of "harmonious Guizhou". From this point of view, this paper not only has profound theoretical value but also has strong practical significance.
