【摘要】：從語義范疇分析,法治政府清單制度是一種具有外部效力的自治性行政規(guī)則。在法理功能上,清單制度內(nèi)涵著政府公信力、法治反腐以及國家治理現(xiàn)代化等多重考量。清單制度的體系結(jié)構(gòu)在層次上涉及中央政府清單與地方政府清單的協(xié)調(diào),在內(nèi)容上是主體性清單與輔助性清單的展開。清單制度的系統(tǒng)塑造包括自主構(gòu)造與委托構(gòu)造、公眾參與與專家參與、多維闡釋與漏洞補充等內(nèi)容。清單制度的監(jiān)督機制包括審查機制、評估機制與公開機制。清單制度的構(gòu)建,有助于促進法治政府的建設(shè)。
[Abstract]:From the semantic category analysis, the government list system of the rule of law is an autonomous administrative rule with external effect. Multiple considerations such as anti-corruption of the rule of law and modernization of national governance. The system structure of the inventory system involves the coordination of the central government's list and the local government's list at the level. In content, it is the development of subjective list and auxiliary list. The systematic molding of list system includes independent construction and entrustment structure, public participation and expert participation. The supervision mechanism of the inventory system includes the review mechanism, the evaluation mechanism and the open mechanism, and the construction of the list system is helpful to promote the construction of the government ruled by law.
