【摘要】：能源是人類社會(huì)賴以生存和發(fā)展的重要物質(zhì)基礎(chǔ)�？v觀人類社會(huì)發(fā)展的歷史,人類文明的每一次重大的進(jìn)步都伴隨著能源的改進(jìn)和更替。我國(guó)能源資源總量比較豐富,但是資源賦存分布不均衡,人均能源資源擁有量較低。隨著我國(guó)經(jīng)濟(jì)社會(huì)的發(fā)展的需要,目前我國(guó)已經(jīng)成為世界上第二位能源生產(chǎn)國(guó)和消費(fèi)國(guó),我國(guó)自有的能源生產(chǎn)能力早已不能滿足經(jīng)濟(jì)發(fā)展的需求,而世界能源主要國(guó)家動(dòng)蕩的局勢(shì)加大了我國(guó)作為能源進(jìn)口大國(guó)的政治和經(jīng)濟(jì)風(fēng)險(xiǎn)。在這種背景下,國(guó)家制定的“立足國(guó)內(nèi),多元發(fā)展”的能源戰(zhàn)略成就了能源資源儲(chǔ)備豐富的西部地區(qū)作為“立足國(guó)內(nèi)”的重要能源基地的地位。然而多年來(lái)西部地區(qū)能源的粗放式開(kāi)發(fā)利用造成資源破壞,環(huán)境污染等嚴(yán)重問(wèn)題,不僅影響了西部經(jīng)濟(jì)社會(huì)發(fā)展,更影響了國(guó)家的能源安全、經(jīng)濟(jì)安全,甚至影響了和諧社會(huì)的建設(shè)。本文基于對(duì)能源資源可持續(xù)發(fā)展和構(gòu)建和諧社會(huì)的思考,從法律視角闡述了西部能源開(kāi)發(fā)問(wèn)題的完善措施。 本論文主要分為四部分。第一部分,以介紹我國(guó)西部能源資源的儲(chǔ)量、開(kāi)發(fā)優(yōu)勢(shì)以及目前開(kāi)發(fā)利用過(guò)程中存在的重大問(wèn)題為切入點(diǎn),分析西部地區(qū)能源的重要戰(zhàn)略地位以及確保其可持續(xù)發(fā)展的重要性。第二部分,主要探討我國(guó)目前整體的能源法制環(huán)境現(xiàn)狀和存在的缺陷。第三部分,分析了主要發(fā)達(dá)國(guó)家是如何通過(guò)法律手段確保本國(guó)的能源安全和經(jīng)濟(jì)社會(huì)發(fā)展,進(jìn)而提出對(duì)我國(guó)能源法律體系建設(shè)和西部能源法制完善的啟示。第四部分是本論文的核心部分,通過(guò)前三章的鋪墊,提出了我國(guó)整體能源法律體系構(gòu)建的設(shè)想,進(jìn)而分析了西部能源法制如何在全國(guó)能源法制完善過(guò)程中促進(jìn)立法的完善以及完善西部法制應(yīng)堅(jiān)持的原則,最后提出了西部地區(qū)法制具體制度的完善的幾點(diǎn)構(gòu)想。
[Abstract]:Energy is an important material foundation for the survival and development of human society. Throughout the history of human social development, every major progress of human civilization is accompanied by the improvement and replacement of energy. However, the distribution of resources is uneven and the per capita energy resources are low. With the development of China's economy and society, China has now become the second largest energy producer and consumer in the world. China's own energy production capacity has long been unable to meet the needs of economic development, and the turbulent situation in the major energy countries in the world has increased the political and economic risks of our country as a major energy importer. The "domestic" set by the State, The multi-development "energy strategy" has achieved the status of the western region with abundant energy and resources reserves as an important energy base "based on the domestic". However, the extensive development and utilization of energy in the western region have caused the destruction of resources for many years. Serious problems, such as environmental pollution, not only affect the economic and social development of the western region, but also affect the country's energy and economic security. Based on the consideration of the sustainable development of energy resources and the construction of harmonious society, this paper expounds the perfect measures of energy development in the west from the perspective of law. This paper is divided into four parts. The first part introduces the reserves of energy resources in western China, the advantages of development and the major problems in the process of development and utilization. This paper analyzes the important strategic position of energy in the western region and the importance of ensuring its sustainable development. The second part mainly discusses the present situation and defects of the energy legal environment in China at present. This paper analyzes how the main developed countries ensure their energy security and economic and social development through legal means, and then puts forward the enlightenment to the construction of China's energy legal system and the perfection of the western energy legal system. Part 4th is the core part of this paper. Through the foreshadowing of the first three chapters, this paper puts forward the assumption of the construction of the whole energy legal system of our country, and then analyzes how the western energy legal system can promote the legislative perfection in the process of perfecting the national energy legal system and the principles that should be adhered to in the perfection of the western energy legal system. Finally, the author puts forward several ideas of perfecting the specific legal system in the western region.
