【摘要】：隨著我國政治經(jīng)濟(jì)的迅猛發(fā)展,城市新建商品房居民區(qū)逐漸成熟,城市社區(qū)民主參與及自治建設(shè)日漸成為我國基層民主發(fā)展和社會生活的重要組成部分。 城市社區(qū)民主參與及自治的過程,主要由社區(qū)居民,業(yè)主委員會,居民委員會,物業(yè)管理公司和政府相關(guān)職能部門共同參與完成。但由于相關(guān)立法的空白和不完善,制度上的不足以及法律法規(guī)操作性不強(qiáng),加上過去“單位制”觀念還有所殘留,共同導(dǎo)致城市社區(qū)民主參與及自治建設(shè)過程出現(xiàn)了各種問題,社區(qū)治理糾紛不斷。 本文針對我國城市社區(qū)民主參與及自治所存在的問題,從居民參與,立法與法規(guī)設(shè)立,政府行政干預(yù)的程度控制等方面進(jìn)行了深度的原因剖析。 最終從城市社區(qū)發(fā)展的內(nèi)部機(jī)制和外部環(huán)境兩個方面,加上對國內(nèi)外先進(jìn)治理經(jīng)驗的分析與借鑒,提出了若干新的想法和具體解決路徑,試圖為城市社區(qū)民主參與及自治的理論研究和實際推廣做一點貢獻(xiàn)。 我國城市社區(qū)民主參與及自治目前總體處于尚不成熟的階段,還有許多課題需要解決。但是隨著中國民主化進(jìn)程的推進(jìn),城市社區(qū)民主參與及自治必將會顯示出強(qiáng)大的活力,推動整個基層民主建設(shè)的發(fā)展,為民主社會的政治經(jīng)濟(jì)發(fā)展發(fā)揮出應(yīng)有的作用。
[Abstract]:With the rapid development of politics and economy in our country, the new commercial housing residential area is gradually maturing, and the democratic participation and autonomy construction of the urban community are becoming an important part of the grass-roots democratic development and social life in our country. The process of democratic participation and autonomy in urban communities is mainly completed by the participation of community residents, owners' committees, residents' committees, property management companies and relevant government functional departments. However, due to the gaps and imperfections in the relevant legislation, The deficiency of the system and the weak operation of laws and regulations, together with the residue of the concept of "unit system" in the past, have led to various problems in the process of democratic participation and autonomous construction of urban communities, and the disputes of community governance have been incessant. In view of the problems existing in democratic participation and autonomy of urban communities in China, this paper makes a deep analysis of the reasons from the aspects of residents' participation, the establishment of legislation and regulations, the degree control of government administrative intervention, and so on. Finally, from the two aspects of the internal mechanism and external environment of the urban community development and the analysis and reference of the advanced governance experience at home and abroad, this paper puts forward some new ideas and concrete solutions. This paper attempts to make some contributions to the theoretical research and practical promotion of democratic participation and autonomy in urban communities. At present, the democratic participation and autonomy of urban communities in China are still at an immature stage, and there are still many problems to be solved. However, with the progress of democratization in China, the democratic participation and autonomy of urban communities will certainly show strong vitality. To promote the development of democracy at the grassroots level and play its due role in the political and economic development of democratic society.
