【摘要】：英國(guó)是當(dāng)今世界兩大法系之一的普通法系的發(fā)源地,英國(guó)法是普通法系的主要代表。英國(guó)是世界歷史上最早完成工業(yè)革命的國(guó)家,完成了前現(xiàn)代農(nóng)業(yè)社會(huì)向現(xiàn)代工業(yè)社會(huì)的巨大轉(zhuǎn)變。英國(guó)法也隨著19世紀(jì)30年代工業(yè)革命的基本完成,開始了一系列變革,闊步走向法治現(xiàn)代化的進(jìn)程。英國(guó)現(xiàn)代法治的發(fā)展進(jìn)程是對(duì)這種大轉(zhuǎn)變的反應(yīng),是工業(yè)主義滲透到法治領(lǐng)域的必然結(jié)果,是英國(guó)法從傳統(tǒng)(前現(xiàn)代)向現(xiàn)代轉(zhuǎn)變的過程。英國(guó)法治現(xiàn)代化模式是經(jīng)驗(yàn)主義的法治現(xiàn)代化模式,其道路是漸進(jìn)改良的內(nèi)生型法治發(fā)展道路。1978年底,中國(guó)共產(chǎn)黨十一屆三中全會(huì)召開,中國(guó)開始了改革開放的歷史進(jìn)程,在法制領(lǐng)域做出“健全社會(huì)主義民主、加強(qiáng)社會(huì)主義法制”的決定,我國(guó)的治國(guó)方略開始從人治到法制、再到法治的巨大轉(zhuǎn)變,中國(guó)法制也開始了由重建到快速發(fā)展的新時(shí)期。到2011年,中國(guó)特色社會(huì)主義法律體系如期形成,我國(guó)經(jīng)濟(jì)建設(shè)、政治建設(shè)、文化建設(shè)、社會(huì)建設(shè)以及生態(tài)文明建設(shè)的各個(gè)方面實(shí)現(xiàn)了有法可依。英國(guó)作為世界歷史上第一個(gè)完成工業(yè)革命的國(guó)家,把其法治現(xiàn)代化作為研究對(duì)象,將有助于我們對(duì)發(fā)達(dá)國(guó)家法治建設(shè)的路徑有一個(gè)宏觀把握。本文運(yùn)用歷史分析法、實(shí)證分析法和比較分析法等綜合性的研究方法,通過對(duì)英國(guó)法治現(xiàn)代化動(dòng)因、進(jìn)程考察,結(jié)合現(xiàn)代化理論研究,總結(jié)出英國(guó)法治現(xiàn)代化建設(shè)的經(jīng)驗(yàn),提出對(duì)我國(guó)法治現(xiàn)代化建設(shè)的借鑒點(diǎn)。 本文共分為四個(gè)部分： 第一部分分析了英國(guó)法治現(xiàn)代化的動(dòng)因。主要分析工業(yè)革命、政黨政治、法律思想與理論對(duì)英國(guó)法治現(xiàn)代化的推動(dòng)作用,并探討了英國(guó)法治現(xiàn)代化為什么以工業(yè)革命的完成為起點(diǎn)。 第二部分闡述了英國(guó)法治現(xiàn)代化的進(jìn)程。英國(guó)工業(yè)革命的完成,實(shí)現(xiàn)了傳統(tǒng)的農(nóng)業(yè)社會(huì)向現(xiàn)代工業(yè)社會(huì)的大轉(zhuǎn)變,在法治領(lǐng)域不斷進(jìn)行變革。將英國(guó)法治現(xiàn)代化進(jìn)程分為起步、發(fā)展、新發(fā)展三個(gè)階段。在起步階段主要是19世紀(jì)的法律改革,有現(xiàn)代司法和訴訟制度的形成、制定法的大量出臺(tái)等；在發(fā)展階段突出的是社會(huì)保障法律體系的建立；在新發(fā)展階段主要是英國(guó)加入歐共體后的法律發(fā)展、社會(huì)保障法律體系的完善、撒切爾的經(jīng)濟(jì)法政策、布萊爾的“第三條道路”。 第三部分重點(diǎn)探討了英國(guó)法治現(xiàn)代化的經(jīng)驗(yàn)。分別為：經(jīng)驗(yàn)主義的法治現(xiàn)代化模式；漸進(jìn)改良的內(nèi)生型法治發(fā)展道路；國(guó)會(huì)立法加強(qiáng),委托立法大增；經(jīng)濟(jì)社會(huì)立法和科技立法加強(qiáng)；法律體系不斷完善；與大陸法系融合的傾向。 第四部分揭示了英國(guó)法治現(xiàn)代化經(jīng)驗(yàn)的當(dāng)代啟示。首先介紹當(dāng)代中國(guó)法治現(xiàn)代化建設(shè)狀況,分為法制的恢復(fù)和發(fā)展、法治的初創(chuàng)和發(fā)展兩部分。其次揭示了英國(guó)法治現(xiàn)代化經(jīng)驗(yàn)的當(dāng)代啟示。分別是：法制建設(shè)要與國(guó)情相結(jié)合；大力發(fā)展社會(huì)主義市場(chǎng)經(jīng)濟(jì)；注重立法制度的改革與完善；加強(qiáng)社會(huì)保障法制建設(shè)。

This article is divided into four parts:
The first part analyzes the driving force of the modernization of the rule of law in Britain. It mainly analyzes the role of industrial revolution, party politics, legal thought and theory in promoting the modernization of the rule of law in Britain, and explores why the modernization of the rule of law in Britain is based on the completion of the industrial revolution.
The second part expounds the law modernization process. The completion of the British Industrial Revolution, the traditional agricultural society to modern industrial society, ongoing changes in the law field. The course of British law modernization is divided into start, development, new development of three stages. In the initial stage is mainly the legal reform in nineteenth Century the formation of modern judicature, and litigation system, formulate a welter of law; is prominent in the development stage of building the legal system of social security; in the new development stage is mainly the development of law after Britain joined the EC, perfect social security legal system, economic law policy of Thatcher Blair, "the third Road".
The third part focuses on the rule of law in modern British experience. Respectively: the rule of law in modern empirical model; the gradual improvement of the endogenous development of the rule of law; Congress to strengthen legislation, delegated legislation to increase; strengthen the economic and social legislation and legislation of science and technology; constantly improve the legal system; and the tendency of continental integration.
The fourth part reveals the Contemporary Enlightenment of legal modernization. The British experience introduces the modernization of contemporary China law, divided into recovery and development of the legal system of the rule of law, the start-up and development of two parts. Then reveals the contemporary enlightenment experience of modernization of the rule of law in England. Namely: the legal construction should be combined with national conditions; vigorously develop the socialist market economy pay attention to; reform and perfect the legislative system; strengthen the legal system construction of social security.
