【摘要】：正"司法是正義的最后一道防線",幾乎已成為法律研習(xí)者、法律實(shí)踐者最耳熟能詳?shù)脑捳Z(yǔ),也是有關(guān)裁判功能最基礎(chǔ)的共識(shí),但何種裁判才能真正地實(shí)現(xiàn)正義?法官在裁判時(shí)應(yīng)如何適用法律?面對(duì)這些問(wèn)題,基于不同的學(xué)術(shù)脈絡(luò),便有著眾說(shuō)紛紜的看法了。對(duì)法官究竟應(yīng)如何裁判的問(wèn)題,喬治·華盛頓大學(xué)特拉亨伯格公共政策與公共管理學(xué)院的布蘭德教授也在《法治的界限》(婁曲亢譯,中國(guó)人民大學(xué)出版社2016年版)一書中也提出了自己對(duì)這一問(wèn)題的系統(tǒng)認(rèn)識(shí)。
[Abstract]:"Justice is the last line of defense of justice", has almost become a law learner, legal practitioners most familiar words, is also the most basic consensus about the function of the referee, but what can the judge really achieve justice? How should a judge apply the law when deciding? In the face of these problems, based on different academic contexts, there are divergent views. Professor Brand of the Trachtenberg School of Public Policy and Public Administration at George Washington University also puts forward his own systematic understanding of this problem in his book the boundaries of the Rule of Law (translated by Lou Qu-kang, Renmin University Press, 2016).
