【摘要】：先秦時(shí)期的德治與法治是一個(gè)古老而又嶄新的話題,也是一個(gè)可以聯(lián)系中國古今歷史的論題,一直以來相關(guān)論述不勝枚舉。德治和法治是最基本的治國方略,先秦儒家主推德治,主張用道德去治理國家;先秦法家主推法治,主張用刑賞去進(jìn)行社會治理,德治與法治的治國手段不同,但歸根結(jié)底都是為了維護(hù)封建統(tǒng)治的人治。本文從先秦時(shí)期德治與法治的哲學(xué)基礎(chǔ)和社會基礎(chǔ)開始分析,分別討論先秦時(shí)期的德治論與先秦時(shí)期的法治論,在深入考察兩種治國方法的歷史局限性的同時(shí),充分挖掘出先秦德治與法治的現(xiàn)代價(jià)值,以發(fā)揮其對現(xiàn)當(dāng)代改革開放與社會主義政治文明,精神文明建設(shè)的指導(dǎo)與借鑒意義。
[Abstract]:The rule of virtue and the rule of law in the pre-Qin period is an ancient and new topic, and also a topic that can be linked to the history of ancient and modern China. The Confucianists in the Pre-Qin Dynasty advocated to govern the country with morality, and the Legalists in the Pre-Qin Dynasty advocated the rule of law and the reward of punishment for social governance, which were different from the means of governing the country by the rule of law. But in the final analysis, it is to maintain the rule of man in feudal rule. This paper begins with the philosophical and social basis of the rule of virtue and the rule of law in the pre-Qin period, and discusses respectively the theory of rule of virtue in the pre-Qin period and the theory of the rule of law in the pre-Qin period. While deeply investigating the historical limitations of the two methods of governing the country, we fully excavate the modern value of the rule of virtue and the rule of law in the pre-Qin period, so as to give play to its guiding and referential significance for the modern and contemporary reform and opening up, the construction of socialist political civilization and the construction of spiritual civilization.
