【摘要】：本文以國家中長期教育發(fā)展規(guī)劃為視角,從民辦學(xué)校教育發(fā)展的歷史、現(xiàn)狀和未來三個維度,用三分法的哲學(xué)思維,詳細(xì)探討了民辦學(xué)校教育的性質(zhì)、法律地位、治理模式、政府政策、外部和內(nèi)部管理等法制因素(環(huán)境)對民辦學(xué)校教育發(fā)展的影響,強調(diào)《中華人民共和國民辦教育促進法》以及《中華人民共和國民辦教育促進法實施條例》具有里程碑的意義——標(biāo)志著我國民辦教育法制環(huán)境的根本改善和民辦教育法制建設(shè)的巨大成就。本文也闡明了民辦學(xué)校教育是我國乃至世界教育發(fā)展進程中的必然產(chǎn)物,探討了目前中國特色社會主義市場經(jīng)濟條件下,民辦教育仍然面臨的現(xiàn)實問題,提出了我國民辦學(xué)校教育法制環(huán)境建設(shè)的設(shè)想和應(yīng)采取的措施,如教師統(tǒng)一委派制、提高準(zhǔn)入資格、民辦學(xué)校質(zhì)量保障和特色創(chuàng)建、堅持民辦學(xué)校教育公共性方向、調(diào)整民辦學(xué)校教育的結(jié)構(gòu)分布等。在新時期,民辦學(xué)校教育受到了公辦教育的強烈沖擊,國家應(yīng)在教育經(jīng)費、稅收優(yōu)惠政策、融資政策等方面給予適當(dāng)扶持,使之順利發(fā)展,成為繁榮我國社會主義教育事業(yè)的重要組成部分。
[Abstract]:From the perspective of the national medium- and long-term education development plan, this paper discusses in detail the nature, legal status and governance mode of private school education from the three dimensions of history, present situation and future development of private school education, with the philosophical thinking of "three points of law". The influence of government policies, external and internal management and other legal factors (environment) on the development of private schools, It is emphasized that the "Law of the people's Republic of China on the Promotion of Private Education" and the "regulations on the implementation of the Law of the people's Republic of China on the Promotion of Private Education" are of milestone significance-marking the fundamental improvement of the legal environment of private education and the non-governmental education in China. This paper also states that private school education is the inevitable outcome of the development of education in China and the world. This paper probes into the practical problems that private education is still facing under the condition of socialist market economy with Chinese characteristics, and puts forward the assumption and measures to be taken in the construction of legal environment of private school education in our country, such as the unified appointment system of teachers. Improve access qualifications, guarantee the quality of private schools and create their own characteristics, adhere to the public orientation of private school education, adjust the structural distribution of private school education, etc. In the new period, private school education has been strongly impacted by public education. The state should give appropriate support in the aspects of education funds, preferential tax policies and financing policies, so as to make it develop smoothly and become an important part of the socialist education cause of our country.
