【摘要】：我國目前處于法治社會建設(shè)的重要時期,而法治建設(shè)除了要有社會的物質(zhì)和階級基礎(chǔ)外,還要有在具體時期,社會群體所秉承的法律的價值觀念作為思想基礎(chǔ)和理論指導(dǎo)。法治社會的建設(shè)要求全社會尤其是廣大公民具有與時代相切合的、正確的法律觀念。中國傳統(tǒng)的法律價值觀,基于其歷史傳承性,對廣大公民的法律觀念具有重要影響。 對中國傳統(tǒng)法律價值觀進(jìn)行研究,能夠有效掌握我國傳統(tǒng)主導(dǎo)的法律價值觀的形成、發(fā)展及法律觀念對社會存在之間相互作用的規(guī)律,進(jìn)而達(dá)到探索出如何對公民所固有的傳統(tǒng)的法律價值觀念進(jìn)行引導(dǎo),形成公民對法律的普遍信仰,以及培養(yǎng)公民的現(xiàn)代法治觀念,引導(dǎo)他們自覺地信賴法律,追求法律正義,養(yǎng)成法律思維定式和依法辦事的觀念,形成占主導(dǎo)地位的法律文化效應(yīng),使法律價值觀的形成、發(fā)展更符合我國法治現(xiàn)代化的價值需求以及有效推動我國整個社會主義法治現(xiàn)代化的進(jìn)程。對于中國傳統(tǒng)法律價值觀及其對當(dāng)代中國法律現(xiàn)代化的影響的研究,筆者主要采取文獻(xiàn)閱讀和比較的方法,首先篩選出客觀的、符合歷史實際的文獻(xiàn)資料以及符合筆者研究所需要的論據(jù)的文獻(xiàn),同時廣泛閱讀相關(guān)的當(dāng)代的學(xué)者論文,從中汲取有利于自身論文研究的理論。并積極尋求導(dǎo)師的指導(dǎo),對研究過程中出現(xiàn)的理論偏差進(jìn)行及時的糾正;同時加強(qiáng)同學(xué)之間的交流和溝通,開拓自己的研究思路。使論文的內(nèi)容符合客觀、真實、富有建設(shè)性的要求。 通過論文的寫作,筆者認(rèn)為,中國傳統(tǒng)的法律價值觀念歷經(jīng)千年,源遠(yuǎn)流長,其中的主導(dǎo)思想是以“仁義忠孝”為核心的儒家倫理思想,其產(chǎn)生于中國古代特有的歷史環(huán)境,并隨著社會的經(jīng)濟(jì)基礎(chǔ)的變化和政治上的需求而有一定的發(fā)展,對社會傳統(tǒng)社會的法律實務(wù)產(chǎn)生重要的影響。 在中國整個傳統(tǒng)法律價值觀所存在的傳統(tǒng)社會中,其更多的在性質(zhì)上表現(xiàn)為對于政治的附屬性,以及作為統(tǒng)治工具的專制性,長期以來就缺乏當(dāng)代法律精神所倡導(dǎo)的公平、公正,追求民主和人權(quán)的價值核心。但同時,在漫長的歷史時空中,中國傳統(tǒng)的法律價值觀念,又對中國社會的穩(wěn)定治理產(chǎn)生了歷史上的積極作用,并且觀念的傳承是歷史和人類社會發(fā)展的客觀規(guī)律,無法斷然采取某些手段徹底糾正或是改變。因此,筆者認(rèn)為,在保證當(dāng)代法律精神所倡導(dǎo)和追求的核心價值觀念的前提下,對于中國傳統(tǒng)的法律價值觀念應(yīng)當(dāng)采用“揚棄”的態(tài)度對待,一方面,我國的法治進(jìn)程要適應(yīng)社會主義發(fā)展的新需要,徹底打擊和廢除傳統(tǒng)法律觀念中封建的、專治的、殘暴的內(nèi)容,而對某些有益于社會治理方面的法律觀念予以保留,或是采取合適的價值引導(dǎo)手段對其進(jìn)行改造,并在新的形勢下將之運用于我國的法治現(xiàn)代化進(jìn)程中,使之煥發(fā)出新的生命力,促進(jìn)我國法治現(xiàn)代化的進(jìn)程。

The values of law that social groups uphold as the ideological basis and theoretical guidance. The construction of a society ruled by law requires the whole society, especially the general citizens, to have a correct legal concept in keeping with the times. Based on its historical heritage, it has an important impact on the legal concept of the broad masses of citizens. The study of Chinese traditional legal values can effectively grasp the formation, development and the law of the interaction between the legal concepts and the social existence of China's traditional legal values. Then we can find out how to guide the traditional legal values of citizens, form the universal belief of the citizens to the law, train the modern concept of the rule of law, guide them to trust the law consciously, and pursue the legal justice. To form the legal thinking pattern and the concept of handling affairs according to law, to form the dominant legal cultural effect and to form the legal values, The development is more in line with the value demand of the modernization of the rule of law in our country and the process of effectively promoting the modernization of the socialist rule of law in our country. The author mainly adopts the method of literature reading and comparison, first of all, screening out the objective, according with the historical reality of the literature and the arguments that the author needs, at the same time, read extensively the relevant contemporary scholars' papers. To learn from the theory conducive to the study of their own papers, and actively seek the guidance of mentors to correct the theoretical deviations that appear in the course of the research; at the same time, to strengthen the communication and communication between students, Open up your own research ideas. Make the content of the paper meet the objective, true, constructive requirements. Through the writing of the thesis, the author thinks that the traditional legal values of China have a long history, the leading thought of which is the Confucian ethics with the core of "benevolence, righteousness, loyalty and filial piety", which originated from the historical environment of ancient China. And with the change of social economic base and political demand, it has a certain development, which has an important impact on the legal practice of the traditional society. In the traditional society in which the traditional legal values exist in China, its nature is characterized by its appurtenance to politics and its despotism as a ruling tool, which for a long time lacks the fairness advocated by the contemporary legal spirit. Fairness, the pursuit of democracy and the core of human rights. But at the same time, in the long history of time and space, Chinese traditional legal values have played a positive role in the stability and governance of Chinese society. And the inheritance of ideas is an objective law of the development of history and human society, and can not be completely corrected or changed by certain means. Therefore, the author believes that under the premise of ensuring the core values advocated and pursued by the contemporary legal spirit, The traditional legal values of China should be treated with the attitude of "sublation and abandonment". On the one hand, the process of ruling by law in our country should be adapted to the new needs of socialist development and thoroughly crack down and abolish the feudal and specialized ones in the traditional legal concepts. The cruel content, while retaining certain legal concepts that are beneficial to social governance, or adopting appropriate value guidance means to transform them and apply them to the modernization of the rule of law in our country under the new situation, Make it radiate new vitality, promote our country rule of law modernization process.
