【摘要】：馬克思、恩格斯創(chuàng)立了為無產(chǎn)階級和勞動人民服務(wù)的唯物主義馬克思主義法學(xué),提出了馬克思主義法治思想。法治就是依法治國。江澤民的法治思想是在繼承馬克思主義法治思想的理論基礎(chǔ)上,結(jié)合了中國當(dāng)今的國情對其進(jìn)行的豐富和發(fā)展。江澤民在黨的十五大報告中提出了“依法治國,建設(shè)社會主義法治國家”的法治思想。 關(guān)于江澤民法治思想的理論和實踐研究的文章有很多,也取得了一定的成果。本文在前人研究的基礎(chǔ)上,力求通過法治和法治思想,再到馬克思主義法治思想層層深入,探討江澤民法治思想對馬克思主義法治思想的繼承和發(fā)展,深入分析從馬克思、恩格斯到江澤民的法治思想發(fā)展的規(guī)律,對構(gòu)建和諧社會具有重要的理論和實踐價值,以更好的指導(dǎo)我國現(xiàn)時期社會主義法治國家的建設(shè)。 第一章導(dǎo)論,主要對研究背景、意義及研究內(nèi)容、方法進(jìn)行簡單的概括和介紹。第二章探討研究了法治和法治思想的歷史淵源和涵義,對和法治、法治思想有關(guān)的幾個概念進(jìn)行了比較分析,為進(jìn)一步分析江澤民對馬克思主義法治思想的繼承和發(fā)展提供了理論基礎(chǔ)。第三章馬克思主義法治思想,從狹義和廣義的馬克思主義法治思想分別進(jìn)行了概念上的闡述。狹義的馬克思主義法治思想是指馬克思、恩格斯的法治觀點(diǎn)、法治理論。廣義的馬克思主義法治思想包括列寧、毛澤東、鄧小平、江澤民到胡錦濤的法治思想。第四章江澤民對馬克思主義法治思想的繼承和發(fā)展。這章是本文研究的重點(diǎn),主要分析了江澤民對馬克思主義法治思想的繼承和發(fā)展的具體內(nèi)容,其中包括概括了法治的涵義、提出了“以德治國”思想、闡明了依法治國的基本途徑、提出了社會主義法治建設(shè)的戰(zhàn)略目標(biāo)、闡述了民主政治的社會主義本質(zhì)、指出了打擊犯罪和反腐倡廉的思路。第五章主要介紹了江澤民法治思想的歷史貢獻(xiàn)和江澤民法治思想對建設(shè)社會主義法治化中國的指導(dǎo)作用。從歷史貢獻(xiàn)和對當(dāng)代社會主義法治化中國指導(dǎo)兩方面探討江澤民對馬克思主義法治思想的繼承和發(fā)展。
[Abstract]:Marx and Engels created Marxist materialism in the service of the proletariat and the working people. Put forward the Marxist thought of rule by law. The rule of law is the rule of law. Jiang Zemin's thought of rule of law is based on the theory of inheriting Marxist thought of rule of law. In the report of the 15th National Congress of the Communist Party of China, Jiang Zemin put forward the rule of law thought of "governing the country according to law and building a socialist country ruled by law". There are a lot of articles on the theory and practice of Jiang Zemin's thought of rule of law, and some achievements have been made. This paper tries to pass the rule of law and the thought of rule of law on the basis of previous studies. Then to the Marxist thought of the rule of law layer by layer, to explore Jiang Zemin's rule of law thought of the inheritance and development of Marxist thought of the rule of law, in-depth analysis of the rule of law from Marx, Engels to Jiang Zemin thought of the development of the rule of law. It has important theoretical and practical value for building a harmonious society, and can better guide the construction of a socialist country ruled by law in the present period of our country. The first chapter is an introduction to the background, significance and content of the research. The second chapter discusses the historical origin and meaning of the rule of law and the thought of the rule of law. Several concepts related to the thought of rule of law are compared and analyzed, which provides a theoretical basis for further analysis of Jiang Zemin's inheritance and development of Marxist thought of rule of law. Chapter three is the thought of Marxist rule of law. From the narrow sense and the broad sense of Marxist legal thought, respectively, the concept of the narrow Marxist legal thought refers to Marx and Engels' views on the rule of law. The theory of the rule of law. The broad Marxist thought of rule of law includes Lenin, Mao Zedong, Deng Xiaoping. Jiang Zemin's thoughts on the rule of law to Hu Jintao. Chapter 4th the inheritance and development of Marxist ideology of rule of law. This chapter is the focus of this paper. This paper mainly analyzes the specific contents of Jiang Zemin's inheritance and development of Marxist thought of rule by law, including generalizing the meaning of the rule of law, putting forward the thought of "governing the country by virtue", and expounding the basic way of governing the country according to law. This paper puts forward the strategic goal of the construction of socialist rule of law and expounds the socialist essence of democratic politics. Chapter 5th mainly introduces the historical contribution of Jiang Zemin's thought of rule of law and the guiding role of Jiang Zemin's thought of rule of law in the construction of socialist rule of law in China. This paper probes into Jiang Zemin's inheritance and development of Marxist thought of rule of law.
