【摘要】： 1831年,法國(guó)的政治家歷史學(xué)家托克維爾,在美國(guó)進(jìn)行了為期9個(gè)月的考察研究后,寫(xiě)下了舉世盛名的學(xué)術(shù)名著《論美國(guó)的民主》,從而托克維爾的理論思想也成為了二戰(zhàn)以后國(guó)際學(xué)術(shù)界眾多學(xué)科中的重要研究對(duì)象之一。 180多年過(guò)去了,這部廣為流傳的經(jīng)典著作,不僅成為世人了解美國(guó)的教科書(shū),也在很大程度上也影響著當(dāng)今美國(guó)人自身對(duì)自己國(guó)家的看法,不過(guò),真正的美國(guó)政治制度究竟如何影響著當(dāng)今的美國(guó)社會(huì),而且這種政治制度是否像托克維爾描述的那樣完美,是本文主要考慮的問(wèn)題。 本文按照“史論”結(jié)合的思路,來(lái)考察和分析美國(guó)民主制度的發(fā)展歷程和演進(jìn),闡述美國(guó)政治制度的基本特征。主要是在歷史分析的基礎(chǔ)上通過(guò)理論分析,來(lái)考察和分析美國(guó)民主制度不斷的演變過(guò)程,以及在這些變化中美國(guó)政治制度的民主性怎樣受到很多因素的影響和制約。在這種影響和制約下,美國(guó)民主制度的真正本質(zhì)內(nèi)涵也是本文研究的首要對(duì)象。 本文共分六個(gè)部分,第一部分,法制的至高無(wú)上,描述了美國(guó)法律在國(guó)家中的地位。通過(guò)對(duì)法律根源的描述,概括出美國(guó)法律的最初起點(diǎn),并且在此基礎(chǔ)上也對(duì)美國(guó)法律制度的局限性加以探究。第二部分,法律規(guī)定的人權(quán)體現(xiàn)的不平等,主要介紹了在法律制度下,聲稱(chēng)自由民主的美國(guó)仍然有很多方面體現(xiàn)著不平等。同時(shí),盡管美國(guó)政治制度自身也對(duì)其進(jìn)行彌補(bǔ),但不可能改變美國(guó)的本質(zhì)。第三部分,兩黨競(jìng)選與金錢(qián)政治,主要介紹了兩黨制為主體的美國(guó),仍然具有金錢(qián)政治的深刻印記并且由此產(chǎn)生的問(wèn)題。在此基礎(chǔ)上,對(duì)美國(guó)的競(jìng)選制度的本質(zhì)進(jìn)行了深刻的揭露。第四部分,三權(quán)分立與總統(tǒng)權(quán)力,主要描述美國(guó)的政治體制架構(gòu)過(guò)程中的立法權(quán),司法權(quán),以及行政權(quán)是怎樣同總統(tǒng)之間進(jìn)行博弈的,這主要根源是因?yàn)榭偨y(tǒng)對(duì)權(quán)力的深深渴望。第五部分,主要描述利益集團(tuán)與社會(huì)民主之間的關(guān)系,這也是美國(guó)民主制度的最顯著特點(diǎn)之一,同時(shí)利益集團(tuán)與美國(guó)的金錢(qián)政治之間的聯(lián)系也是文章所要討論的深層次原因。第六部分,自由企業(yè)制度與管理民主,這部分主要討論的是美國(guó)經(jīng)濟(jì)的最重要載體企業(yè)與這個(gè)國(guó)家的政府之間的關(guān)系研究,并由此揭示美國(guó)的民主制度的特性。 本文的創(chuàng)新之處在于以目前美國(guó)的基本政治制度為出發(fā)點(diǎn),探求美國(guó)政治制度的弊端為我國(guó)今后的政治發(fā)展提供基本思路和大體方向。
[Abstract]:In 1831 , France ' s statesman historian Tokerville , after a nine - month study in the United States , wrote down the famous academic book on democracy in the United States , and thus Tocqueville ' s theory thought became one of the important research subjects in many subjects of international academic circles after World War II . More than 180 years later , the widespread classic works not only become the world ' s understanding of the American textbooks , but also greatly influence the views of the Americans on their own countries . However , the real American political system affects today ' s American society , and whether such a political system is as perfect as Torqueville ' s description is the main consideration in this article . On the basis of historical analysis , this paper explores and analyzes the evolution of American democratic system and expounds the basic features of American political system . It is mainly based on historical analysis to study and analyze the evolution of American democracy and how democracy of American political system is influenced and restricted by many factors . Under the influence and restriction , the real essence of American democracy is also the primary object of this study . This article is divided into six parts , the first part , the supremacy of the rule of law , describes the status of American law in the country . Through the description of the root of the law , the author summarizes the initial starting point of American legal system , and then explores the limitations of American legal system . At the same time , the relationship between the interests group and the social democracy is mainly described . At the same time , the relationship between the interest group and the American monetary politics is mainly discussed . This part mainly discusses the relationship between the most important carrier enterprise of the United States economy and the government of the country , and reveals the characteristics of the democratic system in the United States . The innovation of this paper is based on the present basic political system of the United States , and probes into the malpractice of American political system to provide basic thinking and general direction for the future political development of our country .
